The Ministry of National Defense has responded to the petition of voters of Nghe An province sent by the People's Petition Committee according to Official Dispatch No. 907/BDN dated August 1, 2023.
"Voters propose to amend and supplement the Law on Military Service in the direction of shortening the time of performing military service and increasing the level of financial support when soldiers complete their military service" , the content of the petition of voters of Nghe An province.
Regarding this issue, the Ministry of National Defense said that the term of service of non-commissioned officers and soldiers is stipulated in Clause 1, Article 21 of the Law on Military Service (NVQS) 2015. Specifically, the term of service in peacetime of non-commissioned officers and soldiers is 24 months.
After more than 8 years of implementing the Law on Military Service in 2015, the regulation on the term of active service of non-commissioned officers and soldiers is 24 months, meeting the requirements and tasks of building and improving the combat readiness of the Army. Ensuring the training time, training soldiers to have enough political mettle, technical and tactical skills, use and master the assigned weapons and equipment.
"The reduction of military service time needs to be studied more comprehensively and thoroughly," the Ministry of National Defense commented.
Also according to the Ministry of National Defense, the policies for non-commissioned officers and soldiers serving in active duty, discharged from the military and their relatives are stipulated in Article 50 of the 2015 Law on Military Service and in Decree No. 27/2016/ND-CP dated April 6, 2016 of the Government stipulating a number of policies for non-commissioned officers and soldiers serving in active duty, discharged from the military and their relatives.
Over the years, all levels, sectors and localities have regularly paid attention to and basically ensured full and timely regimes and policies for non-commissioned officers and soldiers serving in the army, discharged from the army and relatives of non-commissioned officers and soldiers serving in the army according to regulations.
However, with the development of all aspects of the country, especially the income of workers, the general level of social life has been significantly raised, the level of demobilization allowance is still low; therefore, it needs to be researched and supplemented to suit reality.
Implementing the direction of the Prime Minister in Official Dispatch No. 924/VPCP-NC dated February 12, 2022 of the Government Office on assigning the Ministry of National Defense to propose amendments and supplements to Laws and Decrees related to the Law on Military Service 2015 in accordance with the Law on Promulgation of Legal Documents 2020.
The Ministry of National Defense has reviewed the implementation of the 2015 Law on Military Service, prepared a dossier to propose the development of a Law amending and supplementing the 2015 Law on Military Service to report to the Government, submit to the National Assembly for consideration and approval and include it in the law and ordinance development program of the 15th National Assembly term.
In response to voters' opinions, the Ministry of National Defense assigned the Steering Committee and the Research Team to propose the drafting of the Law amending and supplementing the Law on Military Service in 2015 to study, synthesize related content and report on proposals to amend and supplement the Law on Military Service in the coming time.
