The announcement clearly stated that the Tan Phu ( Dong Nai ) - Bao Loc (Lam Dong) and Bao Loc - Lien Khuong expressway projects, with the People's Committee of Lam Dong province as the competent authority, had their investment policies approved since the end of 2022.
According to the report of Lam Dong province, up to now, localities have completed the compensation and resettlement support policy framework of the project; supplemented and completed the environmental impact assessment report; preliminary statistics, calculation of volume, scope, area of compensation, site clearance, expected land fund for resettlement, etc. However, currently, these 2 projects are facing some difficulties, the Project has not been approved, affecting the progress of the project commencement, while the Dau Giay - Tan Phu section project, for which the Ministry of Transport is the competent authority, has completed project approval at the end of July 2024.

To promptly remove difficulties and obstacles, promote the progress of projects for which the People's Committee of Lam Dong province is the competent authority, Deputy Prime Minister Tran Hong Ha requested ministries, branches and localities to implement the following contents:
For Tan Phu - Bao Loc section
The Inter-sectoral Appraisal Council (the Ministry of Planning and Investment is the standing body) has commented on the Project Feasibility Study Report. Lam Dong Province soon agreed and commented in writing to confirm the content as proposed at the meeting (no adjustment to increase State capital participating in the project, no proposal to add the mechanism of sharing the reduced revenue) and the adjustment of other contents of the Feasibility Study Report does not lead to the need to adjust the project investment policy according to the provisions of the PPP Law); urgently send a written explanation, complete the Project Feasibility Study Report to the Inter-sectoral Appraisal Council before September 23, 2024 for appraisal;
The interdisciplinary appraisal council shall urgently complete the appraisal of the project's Feasibility Study Report in accordance with the provisions of the PPP Law before September 30, 2024.
Regarding investment mobilization: According to Lam Dong Provincial People's Committee, with the plan of not adjusting the increase in state capital participating in the project and not applying the mechanism of sharing the reduced revenue, the feasibility of the project is not high and reduces its attractiveness to investors and credit institutions.
Lam Dong Provincial People's Committee shall consider reporting to the Prime Minister on difficulties and obstacles regarding regulations on minimum equity capital of investors as prescribed in Decree No. 78/2023/ND-CP dated November 7, 2023 of the Government amending and supplementing a number of articles of Decree No. 32/2017/ND-CP dated March 31, 2017 on State investment credit, and propose that the Prime Minister and the Government consider amending and adjusting the equity capital ratio participating in the project implementation process in accordance with legal provisions on PPP (and send it to the Ministry of Finance) before September 20, 2024.
The Ministry of Finance studies the recommendations of the Lam Dong Provincial People's Committee to propose timely and feasible solutions to issues under the Government's authority (according to the principle of handling the Government's authority immediately), including amending and supplementing Decrees No. 32/2017/ND-CP dated March 31, 2017, No. 78/2023/ND-CP dated November 7, 2023 and No. 28/2021/ND-CP dated March 26, 2021 to ensure compliance with the PPP Law to promptly remove difficulties for projects under the public-private partnership method, and report to the Prime Minister and the Government before September 30, 2024.
For Bao Loc - Lien Khuong highway
This project is under the authority of Lam Dong Provincial People's Council to adjust the investment policy. The adjustment of the State capital participation rate in the project must not exceed 50% according to the provisions of the PPP Law.
Deputy Prime Minister Tran Hong Ha requested the People's Committee of Lam Dong province and investors to actively propose and make efforts to implement tasks to soon start the project in accordance with legal regulations.
During the construction process, it is necessary to have solutions and calculations to balance the excavation - filling ratio or have a plan to reserve excavated soil, ensuring savings, efficiency, and avoiding waste of material resources.
Investment projects in construction of traffic works are given priority.
Regarding the problem related to the area of 02 highway projects overlapping with the Planning for exploration, exploitation, processing and use of minerals in the period 2021-2030, with a vision to 2050: Lam Dong Provincial People's Committee sent a document to the Ministry of Natural Resources and Environment for specific instructions in the direction of taking land use planning as the basis, in which there is land for traffic works, so the investment project to build traffic works is given priority; minerals are included in the reserve planning, reporting to the Prime Minister on the handling results.
Regarding the proposal of Investors to apply the Building Information Model (BIM): Deputy Prime Minister Tran Hong Ha signed and issued Decision No. 258/QD-TTg dated March 17, 2023 approving the roadmap for applying the BIM model in construction activities. This is the most advanced management model, quality management, technology, digitalization of field management that needs to be applied to road projects according to the roadmap. For the 02 projects for which the People's Committee of Lam Dong province is the competent authority, the Ministry of Construction is responsible for reviewing and organizing guidance for the People's Committee of Lam Dong province to implement according to regulations.
Regarding highway rest stops: The Ministry of Transport will study and consider on the basis of the Road Law and the content of the draft guiding document of the Road Law to have a document guiding 63 provinces and centrally run cities in implementing the design and investment of rest stops, electric charging stations, repair and maintenance services, fuel supply, ensuring synchronization; when organizing bidding to select investors, it is necessary to ensure the scope of the entire work package including investment in construction of traffic works and accompanying utility works./.
