Investment projects confirmed to be in the green classification list must meet 2 criteria in Decision No. 21/2025/QD-TTg.
Environmental criteria for investment projects in the green classification list
According to regulations, investment projects confirmed to be in the green classification list must meet the following 2 criteria:
- There is a decision approving the results of the appraisal of the environmental impact assessment report or environmental license or environmental registration according to the provisions of law on environmental protection, except for investment projects exempted from environmental procedures according to the provisions of law.
- Belonging to the field of environmental protection or bringing environmental benefits and meeting the requirements specified in Appendix I of Decision No. 21/2025/QD-TTg.
Competent authority confirms investment projects are in the green classification list
Competent agencies and organizations certifying investment projects in the green classification list include:
1- The competent state agency shall appraise and approve the results of appraisal of environmental impact assessment reports or grant environmental licenses for investment projects in accordance with the provisions of law on environmental protection.
2- Independent certification organization fully meets the following requirements:
a) Have legal status as prescribed by law;
b) Carry out business registration in Vietnam or be established under the decision of a competent state agency;
c) Belong to one of the following types: Business of conformity assessment services or having the function of conformity assessment according to the provisions of law; Business of auditing services;
d) Have a management system and operational capacity that meets one of the following requirements:
National standard TCVN ISO/IEC 17029:2020 or International standard ISO/IEC 17029:2019 on conformity assessment - General principles and requirements for validation and verification bodies;
Vietnamese Standard on Assurance Services No. 3000 - Assurance Services Other than Auditing and Reviewing Historical Financial Information or International Standard on Assurance Services (ISAE 3000) or amended, supplemented, or replaced standards issued by competent authorities of Vietnam in accordance with the provisions of law.
Regulations on confirmation of investment projects in the green classification list
The Decision stipulates that the confirmation of investment projects belonging to the green classification list is carried out at the request of the project investor, the issuer of green bonds and in one of the following forms:
Confirmation by competent state agencies is carried out as follows:
The project investor requests the competent state agency to confirm that the investment project belongs to the green classification list at the same time as handling administrative procedures for appraisal, approval of appraisal results of environmental impact assessment reports or issuance of environmental licenses;
The competent state agency that appraises environmental impact assessment reports or issues environmental licenses shall organize the assessment and confirmation of investment projects in the green classification list during the process of appraising environmental impact assessment reports and considering the issuance of environmental licenses. The confirmation results shall be shown in the decision approving the appraisal results of environmental impact assessment reports or environmental licenses.
Confirmation by an independent certifying organization is performed as follows:
- Project investors and green bond issuers submit documents requesting an independent certification organization to confirm that the investment project is in the green classification list;
- The independent certifying organization shall conduct inspection and review of documents to confirm that the investment project is in the green classification list, ensuring independence and objectivity according to the standards or norms of the independent certifying organization specified in Point d, Section 2 above; the confirmation period and confirmation costs shall be implemented according to the agreement between the independent certifying organization and the project investor and according to the provisions of relevant laws;
- The independent certifying organization is responsible before the law, agencies and organizations implementing preferential policies and State support on green credit, green bonds and relevant agencies, organizations and individuals for its certification results.
The Decree clearly states: Inspection, supervision and handling of violations regarding the confirmation of investment projects in the green classification list shall be carried out in accordance with the provisions of the law on environmental protection and other relevant laws.
Application for confirmation of investment project in green classification list
The Decision stipulates that in case a competent state agency confirms an investment project is in the green classification list , the content of the request for confirmation of the investment project being in the green classification list is shown in the application for appraisal of the environmental impact assessment report or the application for an environmental license, including:
- The content of the request for confirmation of the investment project belonging to the green classification list is shown in the application for appraisal of the environmental impact assessment report or issuance of an environmental license;
- The content of the investment project's explanation that meets environmental criteria includes the contents specified in Appendix III issued with Decision No. 21/2025/QD-TTg and is presented in a separate chapter in the environmental impact assessment report or application for environmental license.
In case an independent certifying organization confirms that the investment project belongs to the green classification list , the application for confirmation that the investment project belongs to the green classification list includes:
- Document requesting confirmation of investment projects in the green classification list according to the form prescribed in Appendix II issued with Decision No. 21/2025/QD-TTg;
- Decision to approve the results of appraisal of environmental impact assessment report in case the investment project is subject to environmental impact assessment or environmental license in case the investment project is not subject to environmental impact assessment but is subject to environmental license or environmental registration in case the investment project is subject to environmental registration according to regulations of law on environmental protection;
- Report explaining the investment project in the green classification list at the time of requesting green credit, issuing green bonds or requesting to enjoy preferential policies and support from the State on green credit and green bonds according to the form prescribed in Appendix III issued with Decision No. 21/2025/QD-TTg.
