Are gasoline, housing and phone allowances included in social insurance contributions?
News from Vietnam Social Security said it has just answered people about whether gasoline, housing, and phone allowances are required to be included in the social insurance salary fund or not.
Specifically, this content is included in Circular 10/2020 dated November 12, 2020 detailing and guiding the implementation of a number of articles of the Labor Code on the content of labor contracts, collective bargaining councils, and occupations and jobs that have adverse effects on reproductive and child-rearing functions.
Accordingly, other supports and allowances such as bonuses stated in the 2019 Labor Code will be recorded as separate items in the labor contract, including initiative bonuses, mid-shift meal allowances or allowances for gasoline, phone, travel, housing, childcare, and childcare will be recorded as separate items in the labor contract.
Similarly, there is also support money when a worker has a relative who dies, a worker has a relative who gets married, on the worker's birthday, or for people in difficult circumstances due to work accidents, occupational diseases, etc.
The 2019 Labor Code clearly states that bonuses are money, assets or other forms that employers reward employees based on production and business results and work completion levels.
Thus, these amounts are not salaries, salary allowances and other supplements, which means they are not included in the salary used as the basis for compulsory social insurance contributions.
