Through inspections of 19 land use projects in Hung Yen province, the Government Inspectorate (GIA) discovered a series of limitations, shortcomings and violations. Among them is the investment project to build technical infrastructure in subdivision A - urban area north of National Highway 5 in Pho Noi urban area, invested by Hoa Phat Urban Development and Construction Joint Stock Company (Hoa Phat Company).

The inspection conclusion announcement stated that the technical infrastructure construction investment project of subdivision A of the urban area north of National Highway 5 is one of four projects selected by the People's Committee of Hung Yen province as an investor to implement the housing project without going through bidding to select an investor.

In addition, the inspection agency pointed out that this project was allocated land since 2018, but by the end of the inspection (May 2023), the land price had not been approved.

From the above inspection results, the Government Inspectorate recommends that the Prime Minister assign the Provincial People's Committee to withdraw Document No. 1488/UBND-KT1 dated July 14, 2016 on continuing to assign Hoa Phat Urban Development and Construction Joint Stock Company as the investor to implement the project because at this time, the Housing Law 2014 and Decree 99/2015/ND-CP dated October 20, 2015 of the Government do not have regulations on the transition for project implementation by using land funds to create capital for infrastructure construction.

At the same time, direct competent authorities to review legal documents to re-bid and select investors for projects using land in accordance with the law.

TTCP also recommended that the People's Committee of Hung Yen province direct the Department of Natural Resources and Environment of Hung Yen province to urgently determine the land use fee payable to the budget for the investment project to build technical infrastructure in subdivision A of the urban area project north of National Highway 5 after re-bidding to select the investor according to legal regulations; ensuring correctness, completeness, and no loss.

It is known that in 2004, Hoa Phat Company was selected by the People's Committee of Hung Yen province as the investor of the urban area project north of National Highway 5, in Pho Noi urban area (My Hao, Hung Yen).

On July 14, 2016, Hung Yen Provincial People's Committee issued Document No. 1488/UBND-KT1 continuing to assign the Company as the investor to implement the project under the land allocation mechanism with land use fee collection.
