Ho Chi Minh City proposes to the Government to have a mechanism to reward and punish contractors according to progress.

According to the Ho Chi Minh City People's Committee, the contract bonus mechanism is necessary to combine with contract penalties and penalties for late progress to promote construction progress and disbursement of projects.

Although the contract bonus mechanism has been regulated by construction law, there are no specific instructions and the source of bonus payment in the construction investment cost structure has not been clearly identified, so it is difficult to implement in practice.

The project to widen Tan Ky - Tan Quy road to 30m (section through Binh Tan district, Ho Chi Minh City) has been sluggish for many years, but is now accelerating to reach the finish line in October 2024.

In order to encourage contractors to improve their sense of responsibility, have solutions to promote and proactively shorten the progress of contract implementation, the Government has issued Decree 15/2023/ND-CP regulating the pilot contract award for construction packages of transport projects in the socio-economic recovery and development program.

However, according to the Ho Chi Minh City People's Committee, the Decree only applies to construction and installation packages of transport projects in the socio-economic recovery and development program.

Therefore, in order to continue to encourage contractors to actively and proactively organize construction in 3 shifts and 4 teams to shorten the construction progress of key projects according to signed contracts in the city, the Ho Chi Minh City People's Committee proposed that the Prime Minister approve Ho Chi Minh City to apply Decree 15/2023/ND-CP to key projects in the city.

The proposal to apply this reward mechanism is also based on the regulations on responsibilities in Resolution 98/2023/QH15 of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City. That is, the issuance of mechanisms and policies in accordance with the authority to adjust and supplement appropriate regulations to resolve shortcomings arising in the practice of city management and development.
