The Department of Agriculture and Environment of Ho Chi Minh City (DARD) has just reported to the People's Committee of Ho Chi Minh City on the implementation of compensation, support, resettlement and land recovery after July 1 according to the provisions of Decree No. 151/2025 on the delimitation of authority of local authorities at 2 levels, decentralization and decentralization in the field of land.
According to the Department of Agriculture and Environment of Ho Chi Minh City, for Group C projects, the establishment of a project compensation council and decisions related to compensation are under the authority of the Chairman of the People's Committee at the commune level to decide and issue. Therefore, the Department of Agriculture and Environment submitted to the People's Committee of Ho Chi Minh City to assign the Chairman of the People's Committee at the commune level where the land is recovered to carry out compensation, support and resettlement work according to regulations. In case of necessity, the Chairman of the People's Committee at the commune level can hire a unit with the function of compensation, support and resettlement to carry out some or all steps in the work of compensation and site clearance for the project.
For projects on the same route but the recovered land area covers the administrative boundaries of 2 communes or more, the land price for the recovered land in which commune will be approved by the Chairman of the People's Committee of that commune. The approval of land prices must ensure consistency, objectivity, and fairness to the rights and obligations of people whose land is recovered. The Department of Agriculture and Environment of Ho Chi Minh City submitted to the People's Committee of Ho Chi Minh City to direct the Department of Agriculture and Environment to participate, give opinions, and support the People's Committees of communes and the Chairman of the People's Committees of communes where the recovered land is located in the process of determining specific land prices at adjacent locations, bordering communes to ensure that land prices are consistent with regulations and actual situations.
Also according to the Department of Agriculture and Environment, regarding the transitional handling of land acquisition, compensation, support, and resettlement, for projects that have approved investment policies before July 1 and are being implemented, the Chairman of the People's Committee at the commune level (where the land is acquired), the project investor, and relevant agencies will continue to lead and direct the work of compensation, support, and resettlement to ensure the progress of ongoing projects so as not to affect the progress of projects that have been allocated compensation capital, as well as disbursement at the rate directed by the Ho Chi Minh City People's Committee.
For projects approved after July 1 and new projects to be implemented in the coming time, the Department of Agriculture and Environment will work with the previous agencies of Binh Duong and Ba Ria-Vung Tau regions and related departments and units to exchange, discuss and agree on compensation, support and resettlement policies when the State reclaims land to implement synchronously and consistently in compensation and site clearance work; synthesize and advise the Ho Chi Minh City People's Committee for consideration and decision.
