Avoid asking many times but not answering clearly about the law

Assessing the results of the review of the system of legal documents according to the provisions of Resolution No. 101/2023/QH15 on the fifth session of the 15th National Assembly , delegate Nguyen Thi Ngoc Xuan (Binh Duong delegation) commented: Many provisions in the Law on Public Investment and other related legal provisions are slow to be amended, many issues have provisions but are slow to be guided, not meeting practical requirements. The delegate recommended that the Government have a detailed plan and list, focusing on perfecting the institutions for the public investment sector.

“The legal corridor in all fields must be clear and complete, avoiding the situation of “asking many times but not answering clearly about which legal document to apply”, causing difficulties and risks for those directly performing public duties”, the delegate said and also suggested that the National Assembly Standing Committee and the Government periodically monitor sub-law documents.

Delegate Nguyen Thi Mai Thoa (Hai Duong Delegation) said that the assessment of the system of legal documents must be carried out carefully and thoroughly, the review must ensure objectivity, the proposed amendments must be appropriate, and it is limited to propose one law to amend many laws.

Based on monitoring and supervising the areas in charge, the National Assembly agencies have commented on the review results and added some contents for the Government, ministries and branches to study and amend. Delegate Hai Duong expressed his agreement with the National Assembly continuing to stipulate this content in the Resolution of the sixth session. In particular, it is necessary to emphasize that the document review activity must be conducted regularly in accordance with the provisions of the Law on Promulgation of Legal Documents to obtain input data for the work of continuing to perfect the legal system.

The delegate emphasized that it is necessary to continue to strengthen the legal force to carry out the work of law-making in general and the work of regular review according to regulations. It is necessary to issue guiding documents to have specific and clear solutions to implement this work.

Delegate Do Thi Viet Ha (Bac Giang delegation) discussed at the meeting.

To resolve the situation of contradictions, overlaps, and incompatibility with reality in legal documents, delegate Do Thi Viet Ha (Bac Giang delegation) suggested that the Government further assess the shortcomings and limitations in this work, in which it is necessary to put in the dialectical relationship between the work of reviewing documents and the construction, completion, inspection, supervision of legal documents and the organization of law enforcement.

At the same time, delegates suggested that it is necessary to clearly identify the causes of the problems and limitations. In particular, it is necessary to clearly identify the responsibilities of agencies, organizations and individuals in order to propose more practical and effective tasks and solutions.
