The Ministry of Industry and Trade proposes new regulations on the Program for building and developing brands for Vietnamese industries.

The Ministry of Industry and Trade is drafting a Decree amending and supplementing a number of articles of Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government detailing the Law on Foreign Trade Management on a number of measures to develop foreign trade, which has been amended and supplemented by Decree No. 14/2024/ND-CP dated February 7, 2024 of the Government.

The Ministry of Industry and Trade said that, according to Article 19 of Decree No. 28/2018/ND-CP, "The program to build and develop brands for Vietnamese industries is a specific, long-term trade promotion program of the Government, ministries, and ministerial-level agencies in charge of implementation to build and promote brands at the national level for industries in accordance with the import-export strategy and industry development strategy for each period, the orientation and objectives of the Vietnam National Brand Program". However, the current difficulties and obstacles are:

Lack of a unified management agency to guide the implementation of programs to build and develop industry brands nationwide leads to resource dispersion and lack of connectivity and synchronization among ministries, branches and localities.

Some key product lines do not have a national brand development program or the implementation is fragmented and not closely linked to the National Brand Program, affecting the overall effectiveness and ability to spread the image of Vietnamese brands to the international market.

Therefore, it is necessary to specifically propose that the Ministry of Industry and Trade take the lead in guiding the implementation of industry brand development programs to ensure consistency, synchronization and close connection with the orientation and goals of the Vietnam National Brand Program.

Program to build and develop Vietnamese product brands

Therefore, in the draft, the Ministry of Industry and Trade proposed to amend and supplement Article 19 regulating the Program for building and developing brands of Vietnamese industries as follows:

The program to build and develop Vietnamese product brands is a long-term, specific trade promotion program of the Government to build and promote brands at the national level for product industries.

The content of the Program to build and develop Vietnamese product brands includes:

a) Develop goals, strategies and plans for developing industry brands for each period; develop a system of criteria and logos for industry brands.

Research, develop goals, strategies and plans for brand development for each industry in each period.

Build and publish a system of evaluation criteria, brand identity and logo for the industry.

Register and protect intellectual property rights for names, logos and brand identity elements of domestic and foreign industries.

b) Support and enhance capacity to build, manage and protect industry brands

Consulting on brand asset management, intellectual property protection, registration of collective trademarks, certification trademarks and geographical indications.

Organize training, coaching, and disseminate knowledge to improve capacity in building, managing, and developing industry brands.

c) Support product development that meets the Program's criteria system

Research and evaluate the needs and applicability of Vietnamese industry branding criteria.

Organize training, coaching, consulting, and dissemination of knowledge to improve product development capacity;

Organize trade connection activities and international cooperation in the field of product development.

Other activities related to product development.

d) Communication and promotion of industry brands domestically and internationally

Investigate, survey, and research the market to guide information and communication activities.

Hire domestic and foreign organizations and consultants to build and promote Vietnamese product brands.

Develop and publish information products; develop and maintain multilingual websites and application software for the Vietnam Industry Brand Program.

Communicate and promote Vietnamese product brands at diplomatic , economic, commercial, trade - investment - tourism promotion events and on media.

Organize seminars, conferences, forums, and weeks to communicate and promote Vietnamese product brands domestically and internationally.

Support in building display areas, introducing product lines on electronic information portals, e-commerce networks, internet networks, and telecommunications networks.

d) Trade promotion activities specified in Article 3 of Decree 28/2018/ND-CP.

The draft clearly states that the subjects participating in and benefiting from the Program are local agencies and organizations, enterprises of all economic sectors, cooperatives, and Vietnamese trade promotion organizations established in accordance with current laws.

Ministries and ministerial-level agencies are responsible for proposing Brand Building and Development Programs for industries under their management. Based on proposals from ministries and ministerial-level agencies, the Ministry of Industry and Trade shall preside over and submit to the Prime Minister for approval a list of Brand Building and Development Programs for industries in accordance with the import-export strategy, domestic trade development strategy, industry development strategy for each period, and the orientation and objectives of the Vietnam National Brand Program.

After being approved by the Prime Minister, ministries and ministerial-level agencies are responsible for presiding over the implementation and ensuring funding from allocated or legally mobilized budget sources according to regulations; at the same time, coordinate with the Ministry of Science and Technology to integrate the building and development of industry brands with the building and development of collective trademarks, certification trademarks, and geographical indications in regions and localities.
