From July 1, 2024, the Law on Identification No. 26/2023/QH15 has officially come into effect. But in reality, there are people who still use Citizen Identification Cards, people who have used Identification Cards. However, there will be some subjects who are required to change.

Regulations on the transition period from Citizen Identification Card to Identity Card

When the Law on Identification comes into effect, there needs to be a transition period from the old form of identification documents to the new form. Accordingly, Article 46 of this Law stipulates the transition period as follows:

Citizen Identification Cards issued before July 1, 2024 will be used until the expiration date printed on the card (except in cases where citizens voluntarily want to renew or are forced to renew due to changes).

Because of this regulation, there are many cases where citizens who have a citizen identification card with a long term, or even an indefinite term (the person who issued the citizen identification card when he or she is 60 years old), will be able to continue using the citizen identification card for many more years.

From now on, these cases must use ID card.

1. Cases of reissuance due to loss, damage, expiration, or first issuance of identification documents after July 1, 2024

When the Law on Identity Cards takes effect from July 1, 2024, those who apply for new or reissued identity cards will be able to switch to the Identity Card form.

According to the Law on Identification, Identification Cards are issued to all citizens regardless of age (Previously, Citizen Identification Cards and Identity Cards were only issued to people aged 14 and over). Therefore, both children and adults are entitled to be issued Identification Cards. From now on, those who are issued for the first time will use ID cards and will not be issued citizen identification cards.

2. Cases where the citizen identification card is still valid but proactively issued a new one

According to the transitional regulations, the issued Citizen Identification Card that is still valid will still be used until the expiration date stated on the card. However, those who have proactively applied for a replacement from July 1, 2024 will be issued a replacement ID card, and the Citizen Identification Card will expire immediately upon issuance of the ID card.

In this case, people should note that the old Citizen Identification Card hard copy is still valid, but the Ministry of Public Security's system has recorded that the card has expired. According to regulations, when a new Citizen Identification Card is issued, the other Citizen Identification Card is revoked, but in reality, there are some cases where the enforcement officer does not revoke it or the citizen does not submit the old copy.

Will I be punished if I intentionally use an old Citizen Identification Card when I have proactively issued a new one?

According to regulations, ID cards or Citizen ID cards must be renewed when they expire. If the renewal procedure is not carried out correctly, the old version must be revoked. People who do not follow the renewal procedure will be warned or fined 300-500 thousand VND. Furthermore, if the identity card expires and is not renewed, when the competent authority requests an inspection and cannot present valid documents, they may also be warned or fined.

In case a citizen has been issued an ID card but still intentionally uses the old ID card in transactions, it will cause legal risks later. Therefore, when proactively changing to an ID card, people should not use the old ID card anymore.
