Drug trafficking and transportation are like twins.
Continuing the 9th Session, on the morning of May 27, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Penal Code.
With 8 crimes proposed to be removed from the death penalty framework, delegate Pham Van Hoa ( Dong Thap Delegation) agreed to remove 6 crimes, leaving 2 crimes (embezzlement, corruption; illegal transportation of drugs).
Expressing his views, the delegate said that so far no one has been sentenced to death for embezzlement or corruption. Recently, there have been cases where the Procuracy has proposed the death penalty for a number of subjects in cases that occurred at Van Thinh Phat Group, SCB Bank and related units and organizations.
According to the delegate, when the Procuracy proposed the death penalty, the defendants' families did not agree. But when the court sentenced them to death, a few days later the families brought money to remedy the consequences of the case, like "redeeming the death penalty".
"The death penalty for these crimes is for prevention, deterrence, and warning. Especially for corruption crimes, the policy of our Party and State is to appropriately punish these subjects," the delegate said, suggesting that these crimes be re-studied.
The delegate continued to cite that Ms. Truong My Lan caused damage and budget losses of millions of billions of dong. This is an unimaginable number, if only half of this amount could be recovered, 50% of the North-South high-speed railway could be built. Therefore, the death penalty should be maintained for this crime.
Regarding the crime of illegal transportation of drugs, the delegate said that this crime and the crime of illegal drug trafficking and possession are like twins, just born before and born after. Because if there were no illegal transportation of drugs, there would be no one to use them.
From the above analysis, delegates proposed to maintain the penalty framework for the crime of illegal transportation of drugs.
The delegates also agreed with not carrying out the death penalty for people with cancer or terminal HIV. They also proposed adding cases of end-stage renal failure and severe liver disease that cannot be treated. "Abolishing the death penalty is also a humane policy of our Party and State," the delegates emphasized.
Must be imprisoned for drug use
Regarding the crime of illegal drug use , delegate Pham Van Hoa said that the lack of criminal prosecution has caused many complaints from the people and voters. Many people who illegally use drugs pose a particularly serious danger to society.
"If we consider drug addicts as sick people and spend money to treat them in rehabilitation camps, but when they leave the camps, the rate of rehabilitation is not much. Therefore, to prevent and deter, we must punish drug use with imprisonment," the delegate stated.

Sharing the same view, delegate Phan Thi My Dung ( Long An Delegation) said that many voters suggested that the law should be made to deal with drug addicts. Currently, drug addicts are only subject to administrative sanctions and are sent to compulsory drug rehabilitation facilities for both drug rehabilitation and treatment.
According to the delegate, the preventive and deterrent effect of this punishment is not high. Addicts are getting younger, the number of addicts is very large, and the rate of relapse after rehabilitation is also very high.
Therefore, the delegate said that the handling of administrative violations against drug addicts is facing difficulties. Therefore, criminalizing this crime is appropriate and has a practical basis and suggested a roadmap for implementation.
