Is it illegal to drink alcohol and drive a motorbike through a breathalyzer checkpoint?

Recently, the traffic police force nationwide has been taking action to handle violations of alcohol concentration with the motto "no exceptions, no forbidden zones". In particular, the Ministry of Public Security has established 6 working groups to directly urge and inspect violations in 58 provinces and cities.

From August 30 to October 15, 6 working groups handed over 6,391 cases of traffic safety violations to local police for handling. Of these, 6,119 were violations of alcohol concentration; 46 cases did not comply with inspection requests.

To avoid inspection, many people who have consumed alcohol have come up with a way to get out of their vehicles and pass through traffic police checkpoints.

Regarding this issue, a representative of Traffic Police Team No. 6 (Traffic Police Department of Hanoi City Police) said that drivers who intentionally push their vehicles through patrol and control posts to avoid traffic violations are committing a violation and will be punished.

The representative of Traffic Police Team No. 6 posed the situation that if the traffic police have evidence that a person has previously been drinking and driving or have images of that person driving, they have the right to stop the vehicle and request a check for alcohol violations.

"By observing behavior, the authorities can detect whether the driver has consumed alcohol or not, such as red face, lack of alertness, staggering while driving... Signs of slowing down to avoid, turning the vehicle around or immediately changing lanes can be immediately recognized," said a representative of Traffic Police Team No. 6.

A representative of Traffic Police Team No. 6 said that the fine for violating alcohol concentration on motorbikes is stipulated in Decree 100/ND-CP as follows:

Driving a motorbike, scooter, or even an electric motorbike after consuming alcohol will be fined from 2-3 million VND if the alcohol concentration in the blood or breath does not exceed 50 milligrams/100 milliliters of blood or does not exceed 0.25 milligrams/1 liter of breath. In addition, violators will have their driving license revoked for 10-12 months.

A fine of 4 - 5 million VND will be imposed on drivers whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams per 100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams per liter of breath. Violators will have their driving license revoked for 16 - 18 months.

A fine of VND6-8 million will be imposed on drivers whose blood or breath alcohol concentration exceeds 80 milligrams per 100 milliliters of blood or exceeds 0.4 milligrams per liter of breath. At the same time, the violator will have their driving license revoked for 22-24 months.

In addition, the vehicle driver will have his vehicle impounded for up to 7 working days.
