Establishing intellectual property rights, increasing tourism competitiveness

Việt NamViệt Nam26/06/2024

(QBĐT) - In reality, besides products serving tourism, such as: culinary specialties, craft village products, agricultural products... registered for intellectual property (IP) protection, there are still many units and enterprises (DN) operating in the tourism industry that have not really paid attention to establishing IP rights. Meanwhile, exploiting intellectual property to develop tourism is a trend, contributing to creating unique and different features for tourism products and services of each locality. This is also considered an effective tool to increase recognition and impression for tourists and a "shield" to protect against unfair competition.

Established in 2011, Netin Information and Tourism Company Limited stands out with many unique tourism products, with their own identity and creativity, innovation, leaving an impression on tourists. Notable among them are tours to explore the nature and unique cultural identity of the Bru-Van Kieu ethnic minorities in Quang Ninh and Le Thuy; explore the Dong Chau-Khe Nuoc Trong Nature Reserve...

According to Mr. Tran Xuan Cuong, Director of the company, the issue of establishing intellectual property rights has been of interest to the company since early on, but for many objective and subjective reasons, it has not been able to be implemented. Recently, when the company began to exploit and introduce some agricultural products to tourists, such as: Wild honey, bananas, etc., registering for intellectual property protection became one of the top goals in the company's operational strategy in the coming time. Because, once this is done, the company's tourism products will have increased prestige and competitiveness in the market; at the same time, this is also a plan to protect from afar and anticipate risks if intellectual property rights are violated.

Realizing the importance of establishing intellectual property rights, more than 7 years ago, Ms. Le Thi Bich and Mr. Ben Mitchell (Bo Trach) registered intellectual property rights for their farmstay and villa system. Ms. Le Thi Bich shared that right from the start of their business, they were interested in intellectual property protection because only then could they limit unfair competition and create recognition for their tourism products, especially after a few disputes arose between some tourism establishments in the use of names, decoration styles, etc. Thanks to the thorough research process and the active support and advice from the Department of Intellectual Property (Ministry of Science and Technology), the registration for intellectual property rights was smooth and soon had results. Since then, they have been more secure and confident in their business and have boldly implemented many ideas and innovations with their own identity.

The director of a tourism company who asked to remain anonymous said that he is currently doing business in various fields such as online food, a hotel and a beach-style cafe, which are very popular. However, although he is interested in establishing intellectual property rights in tourism, he is still really concerned, has not found a reliable and suitable source of support information and wishes to be guided and consulted further on this content. During the business process, he realized that in reality, if his intellectual property is not protected, his products can easily be "stolen" from copyright, copied and used blatantly, and will unintentionally lose competitiveness in the market, falling into a situation of "righteousness and wrongful reasoning".

Recently, he learned about the scandal of a coffee shop in Quang Binh province copying the brand, style... of another establishment in another province. This situation further motivated him to learn and determined to register for intellectual property protection in tourism as an effective way to protect the safety of his business. He really hopes to receive support and active advice from the tourism management agency and related units to soon complete the work.

Deputy Director of the Department of Tourism Le Thi Ngoc Ha: In fact, the number of tourism enterprises registering IP in the province is still quite limited. However, establishing IP in tourism is increasingly becoming an important factor to contribute to making tourism truly a spearhead economic sector, a driving force for socio-economic development in many localities. Quang Binh has the potential and advantages to develop tourism, the Quang Binh Provincial Planning for the period 2021-2030, with a vision to 2050, defines the goal: "Positioning Quang Binh as one of the most attractive tourist destinations in Vietnam, the center of adventure tourism in the Asian region associated with key, unique images, imbued with identity: Nature discovery tourism, cave tourism, cultural and historical tourism, sports tourism, sea tourism, luxury resorts...". To contribute to realizing the goal and positioning the Quang Binh tourism brand, the provincial tourism industry has gradually made efforts to deploy and expand the registration of intellectual property rights.

The Vietnam Tourism Development Strategy to 2030 has identified the issue of protecting intellectual property rights in tourism business as one of the top priorities that needs attention and assigned the Ministry of Science and Technology to coordinate with the Ministry of Culture, Sports and Tourism to actively implement. According to data provided by the Department of Science and Technology, the number of tourism enterprises registering trademarks for intellectual property protection in the province is still not much, mainly large, reputable companies.

Ms. Le Thi Ngoc Ha, Deputy Director of the Department of Tourism, said that, identifying the important role of IP in tourism development and brand positioning, the Department has always created conditions, guided and supported tourism units and businesses in registering IP protection for businesses, tourism products, and tourist destinations; researching and promoting IP in tourism. Thereby, contributing to effectively exploiting potentials, advantages and enhancing brand position and competitiveness in a sustainable manner.

In order to promote protection registration in tourism, first of all, to raise awareness of tourism businesses and units in establishing IP, in the coming time, the provincial tourism industry will research and implement a number of solutions, such as: Communicating in many forms, with rich content about the important role of IP; providing information on Quang Binh tourism digital platforms, guiding and supporting tourism units and businesses to learn and establish IP.

At the same time, the Department strengthens coordination with relevant departments, branches, sectors and units to guide the implementation of relevant regulations to avoid violations due to lack of legal knowledge and strengthens coordination with local authorities in communication, raising awareness of local communities on the development of intellectual property with connectivity and the ability to participate in the tourism chain. The Department also continues to maintain coordination and support for tourism units and enterprises after creating intellectual property in the process of effective management and exploitation.
