Dealing with surplus housing and land: Avoiding resource waste.

Following the reorganization of the administrative apparatus and units, the province has more than 1,000 surplus properties (houses and land) that need to be dealt with. This is a very large amount of public assets; if not managed and utilized promptly, it will lead to neglect, deterioration, misuse, and waste of resources.

Slow processing progress

Yen Son commune was formed by merging Yen Son town and three communes: Tu Quan, Lang Quan, and Chan Son. The new commune has 103 properties with a total area of ​​over 100,476 . To date, 77 properties have been put into use with an area of ​​over 87,722 ; however, there are still 31 surplus properties, including 9 village cultural centers and 22 old school sites, with a total area of ​​nearly 14,816 that cannot be allocated or utilized due to no longer being needed.

According to Le Van Tuan, Vice Chairman of the People's Committee of Yen Son commune, most of the surplus facilities are school buildings and cultural centers that were built a long time ago, are located far from the commune center, are now dilapidated, have small areas, and are difficult to convert to other uses. The locality is proposing to transfer these facilities to the Provincial Land Fund Development Center for management and exploitation. However, to date, there are no specific regulations on the procedures and documents for the transfer, so the surplus public assets are still managed by the villages and schools.

In Minh Thanh commune, a similar situation is unfolding. The commune was formed by merging three communes: Minh Thanh, Luong Thien, and Binh Yen. Currently, the Party Committee, People's Council, and People's Committee offices are located in the former Binh Yen commune; the former Minh Thanh commune office is managed and used by the commune's military force; and the former Luong Thien commune office is scheduled to be handed over to the commune's health station. In addition, the commune has nine surplus school buildings and land plots that have not yet been properly arranged and processed.
The policy of handing over the old Luong Thien commune headquarters to the commune's health station is eagerly awaited by the medical staff at the Luong Thien health station, as the current health station, built in 2010, is now severely dilapidated. However, according to Mr. Duong Minh Toan, a general practitioner at the Luong Thien health station, the old commune headquarters has a large area, and if it is only used as a health station with a small number of staff, it will be difficult to fully utilize its capacity, potentially leading to waste. Meanwhile, the location of this headquarters is not in the center of the new commune, making it difficult for people to access medical services. Therefore, the transfer needs careful study and planning.

Regarding the nine properties (houses, land, and school sites) currently under the temporary management of the Minh Thanh Commune People's Council and People's Committee Office, the situation remains at a state of disrepair, with many properties still abandoned. Meanwhile, some villages need to use these school sites as cultural centers or public playgrounds, but the local authorities have been unable to hand them over due to a lack of specific regulations and guidelines.

Due to the confusion among local authorities, the progress in handling surplus land and buildings in the province is still slow compared to requirements. As of December 14, 2025, the entire province had processed 916 land and building facilities (including 192 surplus facilities due to administrative unit reorganization, and 724 facilities that have been processed through recovery and transfer to local authorities for management and processing); 101 land and building facilities still need to be processed (excluding those already recovered and transferred to local authorities for management and processing). Of the 724 land and building facilities that have been transferred to local authorities, 677 facilities remain unprocessed (including 625 schools and 52 public service facilities and offices).

To enhance the efficiency of managing and utilizing public assets, and to prevent neglect, deterioration, misuse, and waste, on October 10, 2025, the Provincial People's Committee issued Plan No. 86 on the arrangement, allocation, and handling of public offices and assets in the province. The plan requires that the arrangement and handling adhere to the "six clear principles": clear person, clear task, clear responsibility, clear time, clear output, and clear authority; and be linked to land use planning and the socio-economic development plan of each locality.

The plan clearly outlines the responsibilities of heads of agencies, units, and commune-level People's Committees in this work. Any delays, violations, or losses resulting from the misuse of public assets will be held accountable under the law and before the Provincial People's Committee. In addition, the province has issued numerous decisions on the decentralization of authority for the management and use of public assets; regulations on standards and norms for offices, vehicles, machinery, and specialized equipment, creating a legal framework for localities to proactively implement these measures.

Following the province's directives, Yen Minh commune is one of the localities that promptly implemented the arrangement and allocation of surplus houses and land after the merger. Having merged from five commune-level administrative units and located in the former district center, Yen Minh commune has utilized the entire former Yen Minh District Party Committee, People's Council, and People's Committee headquarters as its own. The houses and land of the former district-level agencies and units, as well as those of the communes and towns before the merger, have been transferred to the relevant units for management and exploitation in accordance with regulations.

Typically, Van Chai Ethnic Boarding Primary and Secondary School received the old Van Chai commune headquarters in August 2025. At the start of the new school year, the school moved all administrative offices to the new headquarters, expanded the workspace for subject departments, and significantly improved the living and working conditions of teachers. Mr. Pham Van Dung, Principal of Van Chai Ethnic Boarding Primary and Secondary School, shared: "Utilizing the surplus Van Chai commune headquarters not only helps the school overcome difficulties in terms of facilities but also helps the commune avoid wasting land and buildings after administrative unit reorganization."

Comrade Truong Quoc Khanh, Deputy Director of the Department of Finance, said: Following the direction of the Ministry of Finance and the Provincial People's Committee, the Department of Finance is focusing on urging localities to promptly develop plans for the exploitation and handling of properties and land that have been subject to recovery and transfer to local management, in accordance with the law, by December 2025.

Furthermore, facilities already managed by the Provincial Land Development Center must be put into operation promptly or the land allocation and leasing process must be conducted openly and transparently. Facilities suitable for use as headquarters, medical facilities, educational institutions, cultural centers, and sports facilities should be prioritized for transfer to units in need. In cases where houses and land in remote areas are no longer suitable and no longer needed, demolition and land recovery should be carried out according to regulations.

According to Au Quoc Cong, Director of the Provincial Land Development Center, the center has only recently received land and property assets from localities formerly belonging to Ha Giang province; the handover and acceptance procedures for land and property assets from the former Tuyen Quang province are currently underway. The center is coordinating with localities and relevant departments to propose adjustments to land use and construction planning, thereby developing plans to address and utilize the surplus land and property assets that have been transferred for management.

Resolving the issue of surplus houses and land after administrative unit reorganization is not only a requirement for public asset management, but also a measure of the responsibility and operational capacity of governments at all levels. When each office, school, and land plot is thoroughly reviewed, allocated according to needs, and put into effective use, public assets will continue to serve the people's lives and socio-economic development, contributing to ensuring discipline, preventing waste, maximizing resource exploitation, and creating a foundation for sustainable development for the province in the new phase.

Adjusting the planning to accommodate the handling of surplus land.

To address the issue of surplus public land following the implementation of the two-tiered local government system, the Department has updated and adjusted provincial planning, urban and rural planning, and other relevant plans for properties and land undergoing real estate transfers or functional changes for use as offices, medical facilities, educational institutions, cultural and sports facilities, public purposes, national defense, and security. In cases where buildings require renovation or repair for reuse, specific renovation and repair plans must be in place to ensure their prompt commissioning; measures must be taken to safeguard and protect assets on properties and land that are no longer in use and are undergoing processing; and absolutely no public assets should be left vacant, wasted, or lost.

Managing and utilizing public assets effectively after acquisition.

The effective management and utilization of public assets, especially after the reorganization of administrative units, agencies, units, and schools, has always been a priority for the provincial education sector.

In the context of ongoing difficulties and shortages in classroom facilities, and the need for comprehensive infrastructure and infrastructure development in the general education curriculum, the Department of Education and Training has proactively coordinated with relevant agencies and local authorities to thoroughly review unused land and buildings to propose their reallocation to schools. Converting office buildings into classrooms, functional rooms, or dormitories for boarding students not only significantly saves state budget funds but also addresses overcrowding in central areas and realizes the goal of merging smaller schools into main schools to concentrate resources on improving educational quality in the new phase.

To ensure these resources are truly utilized, the Department of Education and Training will coordinate with relevant departments and localities to closely supervise and manage their use, ensuring that each property received becomes a safe, well-equipped educational environment that meets the learning needs of children from ethnic minority groups in the province.

Following the administrative merger, Xín Mần commune has 4 People's Committee offices and 1 surplus office building from the former communes that have been handed over to the Education sector for use and repurposed. However, the handover of documents and records related to the buildings and land has not been complete; in addition, some facilities such as village cultural centers and school branches lack complete documents proving land use rights, survey drawings, or land allocation decisions, while the updating of asset information in the records is limited, and periodic inventory reports are lacking as required. Given this situation, the locality hopes that the Department of Finance will soon provide specific guidance on standardizing public asset records after the merger and support the appraisal and reassessment of assets, creating conditions for effective management and use by the local authorities, avoiding waste.

Facilitating businesses' access to land.

As a business operating in the trade, service, and tourism sectors, we are very interested in the policy of auctioning surplus houses and land managed by provincial agencies and units. This is the right direction, helping the State effectively utilize land resources and avoid waste, while also creating conditions for businesses to access legally owned land for investment and expansion of production and business.

We hope the province will soon review and publicly announce the list of surplus housing and land plots eligible for auction, along with clear information on planning, intended use, technical infrastructure, and related financial obligations. The auction process must ensure transparency, competitiveness, and compliance with legal regulations, creating an equal investment environment for all economic sectors.

If given access to land through auction, businesses are willing to invest in commercial and service projects that align with the planning, contributing to urban beautification, creating more jobs for local workers, and increasing budget revenue. We expect the province to continue to cooperate and streamline procedures so that businesses can confidently invest for the long term and effectively.
