The Ministry of Agriculture and Environment has issued Circular 29/2025/TT-BNNMT regulating judicial expertise in the fields of agriculture and environment.

This Circular regulates judicial appraisal in the fields of agriculture and environment, including: the field of judicial appraisal; professional standards applicable to judicial appraisal activities; judicial appraisal time limit; judicial appraisers, judicial appraisers by case, judicial appraisal organizations by case; procedures and responsibilities for organizing the implementation of judicial appraisal.

Field of forensic examination

The Circular stipulates 21 areas of judicial expertise in agriculture and environment, including:

1- Cultivation and plant protection; 2- Animal husbandry and veterinary medicine; 3- Forestry; 4- Salt industry; 5- Aquaculture; 6- Irrigation; 7- Dyke management and natural disaster prevention and control; 8- Food safety of agricultural, forestry, aquatic products and salt; 9- Quality management of plant varieties, livestock, poultry, pets, tools, equipment, materials, products and services of agriculture, forestry, salt industry and aquatic products; 10- Preservation, processing and transportation of agricultural, forestry and aquatic products; 11- Land; 12- Water resources; 13- Geology and minerals; 14- Environment; 15- Nature conservation and biodiversity; 16- Hydrometeorology; 17- Climate change; 18- Surveying, mapping and geographic information; 19- Integrated management of resources and protection of the marine and island environment; 20- Remote sensing; 21- Investment management, investment in construction of specialized works in the fields of agriculture and environment.

Time limit for judicial appraisal

Clause 2, Article 26a of the Law on Judicial Expertise stipulates:

The time limit for judicial expertise in cases where judicial expertise is required is implemented according to the provisions of the law on criminal procedure.

The Circular stipulates that the maximum period for judicial appraisal in the field of agriculture and environment is 03 months, except for the case specified in Clause 2, Article 26a of the Law on Judicial Appraisal 2012, amended and supplemented in 2020.

In case the judicial appraisal case is complicated or has a large volume of work or involves many fields and is under the responsibility of many agencies and organizations, the maximum appraisal period is 04 months.

The period of judicial appraisal may be extended but not more than half of the maximum period mentioned above, as decided in writing by the agency requesting the judicial appraisal upon request of the individual or organization performing the judicial appraisal.

In case of problems arising or there is a basis to determine that the appraisal cannot be completed on time, the individual or organization performing the forensic appraisal must promptly notify in writing, clearly stating the reasons to the person requesting the appraisal and the expected time of completion, and issue a conclusion on the forensic appraisal.

The time limit for judicial appraisal is calculated from the date the individual or organization conducting judicial appraisal receives the decision to request judicial appraisal and receives complete records, appraisal objects, information, documents, objects, and samples necessary for judicial appraisal.

In case it is necessary to supplement the dossier and documents as a basis for the appraisal, the individual or organization conducting the judicial appraisal shall send a written request to the agency or person requesting the judicial appraisal to supplement the dossier and documents; the time from the time of the written request to the time of receiving the supplementary dossier and documents shall not be counted in the judicial appraisal time limit.

The Circular takes effect from August 11, 2025.
