Who is responsible for false advertising of drugs and functional foods?

On the afternoon of November 7, at the question and answer session, delegate Tao Van Giot (Lai Chau delegation) questioned the Minister of Information and Communications (MIC) about solutions to handle false advertising of functional foods and drugs on cyberspace. The delegate said that recently, there has been a situation where social networking sites such as Zalo, Facebook, Tiktok, Youtube or websites with servers abroad have advertised health protection foods that have not been assessed and the advertising content is incorrect.

In fact, advertising food as medicine using the names of agencies such as health, cutting and pasting images of VTV, the Ministry of Health and hospitals; providing feedback from patients and celebrities to advertise food with disease treatment effects is still quite common and complicated, causing confusion and damage to consumers, especially people in rural areas, ethnic minority areas, and areas with little information.

The delegate asked the Minister to provide a solution to handle this issue fundamentally and long-term in accordance with the spirit of Resolution 75 of 2022, 4th Session, 15th National Assembly ?

Responding to questions, Minister of Information and Communications Nguyen Manh Hung said that regarding the issue of false advertising of functional foods and drugs on cyberspace, these advertisements are basically carried out on social networks, especially cross-border social networks. Therefore, the authorities have reached a working mechanism with these social networks to remove false information, false advertising, and toxic information. This issue has been institutionalized in legal documents, including the responsibility of social networks and the time for removal.

According to the Minister, currently, the implementation of State management requirements on removing false information on social networks, including social networks, is being carried out very seriously.

“The problem is to detect and report to resolve. Currently, whichever ministry, sector or locality manages something in the real world must move to cyberspace and manage that area in cyberspace. If implementation is difficult, there will be support from two core ministries, the Ministry of Information and Communications and the Ministry of Public Security. But the main task must still be the specialized ministries. Talking about medicine and functional foods, which is right, which is wrong, whether advertising is right or wrong, is the responsibility of the Ministry of Health,” said Minister Nguyen Manh Hung.

The Minister said that currently, not many ministries, branches, and localities are on cyberspace and still think that this is the sole responsibility of the Ministry of Information and Communications or the Ministry of Public Security: “I think that this perception needs to be changed. I really hope that we can determine the responsibilities of our ministries, branches, and localities in the real world and do the same in cyberspace. In the process of removing bad, toxic, and untrue information, if you encounter any difficulties, please send an official dispatch to the Ministry of Information and Communications, we are ready to support you.”

Will institutionalize fanpage identity authentication

Questioning the Minister of Information and Communications, delegate Vo Thi Minh Sinh (Nghe An delegation) highly appreciated the efforts of the industry and agreed with Report No. 510 with many remarkable results.

In particular, delegates were very pleased with the breakthrough results in working with cross-border social networking platforms such as Facebook, Google or Tiktok to require them to comply with Vietnamese law and the Code of Conduct on social networks on a handbook for identifying and handling fake information for users.

However, currently there are many organizations and agencies in the political system that have fanpages on Facebook, which are very effective in propaganda work and interacting with people, but have not been granted official accounts.

Given the above reality, delegate Vo Thi Minh Sinh requested the Ministry to provide solutions to support the orientation and legalization of these sites to ensure safety, avoid risks, loss of operational control or responsibility of these sites towards society?

Responding to questions, Minister Nguyen Manh Hung said that currently many organizations have pages on social networks and want those pages to be authenticated. Through that authentication, information can be conveyed to society and the reputation of the page can be demonstrated.

According to the Minister, currently, some social networking platforms are available and support this feature. For example, Facebook has a "blue tick". When providing complete information and being authenticated as that organization, they will issue a "blue tick". When users see the "blue tick", they will see the reputation of that organization.

However, not all social networks have authentication functions like Facebook. Therefore, the Ministry of Information and Communications has worked with social networks that do not have this function to develop this function.

“Basically, by the end of this year, major social networks will have this function and the Ministry of Information and Communications will institutionalize this function in a decree expected to be signed in the fourth quarter of 2023 on Internet content,” said Minister Nguyen Manh Hung./.
