Binh Thuan: Violating bidding regulations causes serious consequences

The Investigation Police Agency of Binh Thuan Province Police has decided to prosecute the criminal case of “Violating bidding regulations causing serious consequences” occurring at Binh Thuan General Hospital and Binh Thuan Center for Disease Control (CDC). The prosecution decisions have been approved by the People's Procuracy at the same level.

Accordingly, based on the results of verifying reports of signs of crime occurring at Binh Thuan Provincial General Hospital and Binh Thuan Provincial Center for Disease Control related to the purchase of Real-time PCR testing systems, COVID-19 testing kits, consumables, and chemicals from Viet A Technology Joint Stock Company and Hop Nhat Science Limited Liability Company during the period from 2020-2021.

After determining that there are signs of the crime of "Violating bidding regulations causing serious consequences" as prescribed in Clause 3, Article 222 of the Penal Code; based on Article 36, Article 143, Clause 1, Article 153, Article 154 of the Criminal Procedure Code; the Head of the Investigation Police Agency of Binh Thuan Provincial Police issued a decision to initiate a criminal case for investigation.

The investigation determined that in the two years 2020-2021, the Provincial General Hospital purchased equipment, medical supplies, biological products, and testing kits to serve the prevention and control of the COVID-19 epidemic worth more than 71 billion VND with 20 bidding packages, the value of the implemented contracts was nearly 69 billion VND.

In 2020-2021, Binh Thuan Provincial Center for Disease Control purchased medical equipment, supplies, biological products, and testing kits for epidemic prevention and control with a total cost of more than 198 billion VND, along with 53 bidding packages. The value of the implemented contracts is more than 190 billion VND.

Regarding Viet A Company's test kit, in 2020-2021, Binh Thuan province spent more than 130 billion VND to buy this company's test kit.

Previously, in February 2025, the Investigation Police Agency of Binh Thuan Provincial Police decided to prosecute the criminal case of "Violating bidding regulations causing serious consequences" occurring at Binh Thuan General Hospital.

This case involves the Provincial General Hospital purchasing equipment and ventilators supplied by Minh Khoa Medical Equipment Company Limited in 2020, including: The 2020 COVID-19 prevention equipment procurement package (16 devices) with a winning bid price of over VND 10.7 billion, while the purchase price was only VND 5.7 billion. The package to purchase five ventilators, with a winning bid price of over VND 3.4 billion, while the purchase price was nearly VND 1.8 billion.

In addition to the two above packages, the 2021 medical equipment procurement package of Binh Thuan Provincial General Hospital was also won by Minh Khoa Company for more than 10 billion VND, while the purchase price was only 4.9 billion VND.

The total value of the above mentioned bid packages is more than 24.2 billion VND, while the purchase price is only nearly 12.5 billion VND, an increase of 94%. In addition to the large difference in the amount, the Investigation Agency also discovered that the inclusion of criteria in the bidding documents that could potentially limit the participation of bidders, creating conditions for a winning bidder, is an irregularity./.
