On September 30, at the regular press conference of the Government in September 2023, answering reporters' questions about the case of Ngo Thi To Nhien appropriating documents of agencies and organizations, Lieutenant General To An Xo, spokesman of the Ministry of Public Security, said that based on the investigation results, documents and evidence collected, on September 20, the Hanoi City Police Department of Security Investigation issued a decision to prosecute the case, prosecute the accused, and temporarily detain Ngo Thi To Nhien, born in 1974, Director of Vietnam Energy Transition Initiative Company Limited, for the crime of Appropriating documents of agencies and organizations under Article 342 of the Penal Code.
Also arrested with Ngo Thi To Nhien were Duong Duc Viet, born in 1979, senior specialist of the Investment Management Board of the National Power Transmission Corporation (under EVN) and Le Quoc Anh, born in 1984, Head of System Analysis Department, Electricity Consulting Company 1, with the same charges.
Based on the investigation results and collected evidence, the police determined that since 2020, Ngo Thi To Nhien knew that Le Quoc Anh and Duong Duc Viet were the ones with access to information and documents related to EVN's power grid development policy planning such as the 500 kV and 220 kV grids, etc., so Nhien legalized the appropriation of documents by signing labor contracts and expert contracts with Le Quoc Anh and Duong Duc Viet on a part-time, paid basis. With this position, the two defendants provided documents related to EVN to Nhien.
The actions of the three defendants above constitute the crime of appropriating documents of agencies and organizations. Currently, the police are continuing to expand the investigation of the case.
After Ngo Thi To Nhien was prosecuted, a number of foreign media agencies and some reactionary exile organizations reported distorted news, falsely accusing Vietnam of arresting environmental activists.
Regarding this, Lieutenant General To An Xo said, "The Ministry of Public Security rejects the above-mentioned distortions and considers it an act of interference in Vietnam's internal affairs."
