Supplementing regulations to protect teachers in the Law on Teachers

Mr. Vu Minh Duc, Director of the Department of Teachers and Educational Managers, Ministry of Education and Training, emphasized that the Law on Teachers clarifies the rights and obligations of teachers in the direction of increasing the initiative, creativity and protection of teachers in professional activities. The Law on Teachers increases the institutions to protect teachers through the rights and prohibitions of related individuals and organizations towards teachers.

The Law on Teachers, which has just been passed by the National Assembly , will officially take effect from January 1, 2026 with many breakthrough policies. In addition to the things that teachers are not allowed to do, the Law on Teachers also provides specific regulations on what organizations and individuals are not allowed to do towards teachers. This includes requiring organizations and individuals not to post or disseminate information that attributes responsibility to teachers in professional activities without a conclusion from a competent authority. This is considered a humane approach not only to protect the reputation and honor of teachers but also an important sanction to protect a healthy learning environment for learners.

Many opinions say that this regulation is necessary to protect teachers, especially in the context of social networks and online media developing strongly as today, in which, once information is posted online, it can be accessed forever. In reality, if teachers commit violations, there are sanctions according to regulations, but due to the special nature of teachers' professional activities, especially when teachers directly teach in class, they have a great influence on the psychology of students. Therefore, if there is no plan to protect teachers, the affected subjects will not only be teachers but also students.

Dr. Dang Van Cuong, lecturer of Criminal Law, Thuy Loi University, said that the regulation of not posting or disseminating information that attributes responsibility to teachers in professional activities without a conclusion from a competent authority is in accordance with the Constitution and the law to protect personal privacy, protect the honor, dignity and reputation of teachers and in accordance with the general principles of the law. The regulation does not condone or assist in teachers' violations but protects the confidentiality of information during the verification and settlement of complaints and denunciations; at the same time, it protects personal rights, image rights, personal privacy and contributes to reducing negative consequences from social issues.

According to Dr. Dang Van Cuong's analysis, when information is unclear and violations have not been concluded by competent authorities, protecting information is appropriate and necessary. In reality, even with defendants in criminal cases, they are only considered guilty when there is a legally effective verdict from the court. Therefore, when there is no conclusion from competent authorities, any conjecture, judgment, and attribution of public opinion can create mistakes and cause negative impacts that are difficult to correct.

Society and the law always require teachers to be exemplary models, to respect the law and professional ethics, so if teachers violate these principles, they must be held responsible before the law. But before the final conclusion takes legal effect, teachers need to be protected. In the case where there is an official conclusion from the competent authority, determining that there is a violation, the violation will be handled according to the provisions of the law and there are no exceptions.

Mr. Nguyen Dac Vinh, Chairman of the National Assembly's Committee on Culture and Society, also said that this regulation is necessary to protect the reputation and image of teachers from abuse, speculation and dissemination of information that has not been verified, without official opinions or conclusions from competent authorities. For cases that have not been inspected or examined, information can still be reported if signs of violations or negative manifestations are detected. For cases that are being inspected or examined without conclusions from the inspection or examination agency, information disclosure is not allowed because it may affect the objectivity of the inspection or examination process. In addition, this regulation does not contradict the right to access information, rights, obligations and prohibited acts in the Press Law, the Law on Network Information Security, the Civil Code and other regulations.
