Among the 27 National Assembly deputies who gave their opinions on the Teachers’ Law, many expressed their concern about the regulations on the authority to recruit teachers. Minister Nguyen Kim Son emphasized that the Teachers’ Law assigns the education management agency to be the agency in charge of recruiting teachers in public educational institutions, directly the Department of Education and Training. This regulation will facilitate the organization of recruitment councils, from the organization to the exam questions and grading.
The general spirit is decentralization, decentralization, "wherever labor is used, there is the right to recruit". However, this is difficult to implement at the preschool level, and primary schools will have difficulty establishing a recruitment council. In fact, to establish this council, strict requirements and regulations are needed. Therefore, the education management agency will play the role of organizing recruitment.
" It is possible to consider decentralization to qualified facilities; for example, if high schools have enough conditions and capacity to organize recruitment, they are ready to decentralize," Minister Son added.

Regarding the opinions of delegates wishing to expand the beneficiaries of policies as well as the identification of teachers, the Minister said that the law only regulates those who work as teachers, as professionals and meet standards.
Other positions such as school staff, those involved in the educational process, and those involved in educational activities will have different regulations. For those who guide students, students in practice, etc., only experience, skills, and expertise are needed to encourage participation in this activity.
Also at the discussion session, many opinions suggested that localities should not be encouraged to issue additional policies to support education. This is to ensure fairness and to prevent remote provinces from having difficulty attracting teachers.
However, according to the Minister, for some localities with conditions, we should encourage and allocate resources to support education and teachers. For example, Ho Chi Minh City - recently proactively allocated funds to support teachers' lives to make them less difficult. From there, it limits the situation of teachers transferring or quitting their jobs. This policy is very valuable and should be encouraged.
Minister Son acknowledged that we support equity in education if the above policy is good and fair. How can teachers have the conditions to enjoy the best regime and policies? Equity should not make everyone suffer and have the same difficulties.
"We should encourage places with conditions, and in places without conditions, the State needs to have more support policies for those localities," said the Minister.
In fact, teachers in remote areas and ethnic minority areas are enjoying many preferential policies. Therefore, it is necessary to encourage localities to have more policies to support teachers. Both the central and local governments care for the education cause and teachers.
The Law on Teachers was submitted to the National Assembly from the 8th Session, and is expected to be consulted and approved on June 11 - 9th Session, 15th National Assembly.
In the report explaining and accepting the revision of the Teachers Law, the National Assembly Standing Committee stated that assigning recruitment authority to the education sector is necessary, creating conditions for the sector to be proactive in recruiting, using, managing, and developing teachers, meeting the requirements on quantity, structure, and quality; contributing to overcoming the situation of local surplus, shortage, and imbalance in the structure of teachers.
The draft law stipulates the recruitment of teachers according to educational levels and training qualifications. For schools of the People's Armed Forces, the recruitment of teachers is regulated by the Minister of Public Security and the Minister of National Defense.
For other educational institutions, the recruitment of teachers is decided by the competent authority managing the educational institution. At the same time, the Government is assigned to specify in detail the contents related to the recruitment of teachers in public educational institutions and foreign teachers.
The draft law also clearly stipulates the subjects, principles of mobilization, authority of mobilization, cases in which teachers cannot be mobilized; adds cases of mobilization to work in ethnic minority areas, mountainous areas, border areas, and islands to address policies for these subjects. The National Assembly will assign the Government to specify in detail the procedures for mobilizing teachers.
