Commenting on the revised Enterprise Law at the group discussion session this afternoon (May 10), delegate Truong Trong Nghia (HCMC delegation) pointed out the current situation, currently businesses are encouraged to register procedures in the direction of digital transformation everywhere, but regulations still require registration based on documents. When the inspection and examination agencies come to work, they ask for paper documents.
Delegate Nghia cited that there are businesses that are miserable because they sign contracts electronically, via email, but when doing export procedures, customs still requires paper documents. This needs to be more clearly defined in this revised bill so that businesses can use digital and electronic forms in transactions and document storage.
Not to mention, the process of storing documents will be subject to termites, floods, and fires, causing risks and damage. Meanwhile, there are many digital, electronic tools that ensure safety and can be stored in many different ways.

According to the delegate, it is necessary to overcome the situation of going to the business registration address but there is no business there, and when going to inspect and supervise, there is no sign of the business owner. Currently, there are still many omissions in the business registration and post-inspection stages.
The draft amended law does not continue to stipulate that business founders must submit a criminal record to the business registration agency. The delegate said that at a discussion session in the 13th National Assembly , he requested a criminal record because at that time, businesses asked tenants to register their houses on their behalf, and asked motorbike taxi drivers to register their names on their behalf.
"There are cases where, after a crime has occurred, the person is serving a sentence but is still a business owner and still doing business. Therefore, a criminal record will solve that problem," said the delegate.
To reduce the burden of administrative procedures, delegates proposed replacing the regulation that the business registration agency will coordinate with the management agency in necessary cases according to the provisions of the Law on Judicial Records with the requirement to coordinate to ensure a cleaner business environment.
Sharing the same view, delegate Le Thu Ha ( Lao Cai Delegation) said that it is necessary to promote the use of personal identification codes instead of many traditional documents in business registration. This is a very remarkable step in the national digital transformation process and is an essential part to reduce administrative costs, prevent negativity and combat the establishment of "ghost" businesses.
“We already have a foundation of a national database on population and personal identification codes that almost covers the entire population. The important thing now is to connect, share and interconnect the system, avoiding the situation where each agency keeps a separate data warehouse,” said Ms. Ha.
According to delegates, the Government needs to identify this as a priority program in national digital transformation, with a specific roadmap and sanctions requiring ministries, branches and localities to coordinate, share and synchronize data.
