It is necessary to develop a Law on Management and Protection of National Defense Works and Military Zones.

On May 26, continuing the program of the 5th Session of the 15th National Assembly, presenting the draft Law on Management and Protection of National Defense Works and Military Zones, Minister of National Defense Phan Van Giang said: National defense works and military zones are state assets, assigned to the Army and authorities at all levels to organize construction, management, use and protection to serve the cause of building and protecting the socialist Vietnamese Fatherland. The management and protection of national defense works and military zones is the responsibility of Party committees, authorities at all levels and all people, with the core being the military force.

However, after 28 years of implementation, the Ordinance on Protection of National Defense Works and Military Zones has revealed difficulties and inadequacies, some contents have not kept up with the socio -economic development situation and the guidelines, lines and policies of the Party and State on the task of protecting the Fatherland in the new situation; at the same time, some contents regulating the restriction of human rights and civil rights in the Ordinance are not consistent with the provisions of the 2013 Constitution. Therefore, it is necessary to develop a law on the management and protection of national defense works and military zones.

Regarding the political basis, Minister of National Defense Phan Van Giang affirmed that since 1995, our Party has issued many policies and viewpoints on protecting the Fatherland, building an all-people national defense, and building a people's war posture that need to be further institutionalized, such as Resolution No. 28-NQ/TW dated September 22, 2008 of the Central Executive Committee (10th tenure) on continuing to build provinces and centrally-run cities into solid defense zones in the new situation; Resolution No. 28-NQ/TW dated October 25, 2013 of the Central Executive Committee (11th tenure) on the Fatherland Defense Strategy in the new situation; Resolution of the 13th National Party Congress has set out the orientation for national development in the 2021-2030 period.

Minister of National Defense Phan Van Giang stated that the Party's policies and viewpoints need to be further fully specified to create a legal basis for implementation. This includes perfecting the law on management and protection of defense works and military zones to contribute to strengthening national defense potential, building and consolidating a solid national defense, closely linked to the country's socio-economic development.

Regarding the legal basis, Minister of National Defense Phan Van Giang said that the management and protection of defense works and military zones have regulations restricting the right to travel and activities of individuals and organizations in certain cases, which are currently only regulated in sub-law documents. Therefore, it is necessary to develop a draft Law on Management and Protection of Defense Works and Military Zones to ensure compliance with the provisions of the Constitution.

The 2018 Law on National Defense stipulates the national defense, military zone defense, and defense areas: "The national defense is the national defense strength of the country, built on the foundation of politics, spirit, human resources, material resources, finance, with the nature of the whole people, comprehensiveness, independence, autonomy, and self-reliance" (Clause 1, Article 7)... To build, consolidate, and strengthen national defense potential, build a solid, synchronous, and unified defense area according to the provisions of the Law on National Defense, it is necessary to promulgate specialized laws to create a legal basis for the management and protection of national defense works and military zones.

Regarding practical basis, Minister Phan Van Giang stated that after 28 years of implementation, the Ordinance has revealed a number of difficulties and inadequacies, such as: The determination of the scope and boundaries of protection of defense works and military zones has not been specifically and clearly regulated; there are still phenomena of illegal encroachment and cultivation in the scope assigned for management and protection; the coordination between localities with the Ministry of National Defense and military units in determining the scope and boundaries for management and protection has not been implemented synchronously...

Therefore, Minister of National Defense Phan Van Giang affirmed that the development of the Law on Management and Protection of National Defense Works and Military Zones is necessary to perfect the legal system on national defense, contributing to building a socialist rule-of-law state.
