Internship regime according to the provisions of the Law on Cadres and Civil Servants

For those who are performing the probationary regime according to the provisions of the Law on Cadres and Civil Servants 2008 and are classified into the commune-level civil servant category (in charge of education and training) corresponding to the recruited job position, will the salary from July 1, 2025 be applied to receive 100% of the salary of the specialist category, or will it still be applied for the last 6 months of 2025, and must receive 85% of the salary according to the specialist category as a trainee? Clause 4, Article 70 of Decree No. 170/2025/ND-CP stipulates: From July 1, 2025, people who are undergoing probationary regime according to the provisions of the Law on Cadres and Civil Servants No. 22/2008/QH12, which has been amended and supplemented by a number of articles under Law No. 52/2019/QH14, shall be classified into the civil servant rank corresponding to the recruited job position.

The review and assessment of the probationary period before July 1, 2025 shall be carried out in accordance with the provisions of Decree No. 138/2020/ND-CP dated November 27, 2020 of the Government regulating the recruitment, use and management of civil servants, amended and supplemented by Decree No. 116/2024/ND-CP dated September 17, 2024 of the Government amending and supplementing a number of articles of Decree No. 138/2020/ND-CP dated November 27, 2020 regulating the recruitment, use and management of civil servants and Decree No. 06/2023/ND-CP dated February 21, 2023 regulating the quality assessment of civil servant input.

In case the competent authority evaluates and comments that the requirements are not met (only applicable to those with a probationary period of 6 months or more as of June 30, 2025), the recruitment decision will be cancelled according to regulations. Accordingly, from July 1, 2025, those who are assigned to a new commune-level job position will receive 100% of the salary corresponding to the specialist level (the probationary period ends from July 1, 2025).
