Draft regulations on professional standards for university lecturers

Ensure consistency and synchronization with current legal documents

This Circular replaces the provisions in Articles 3, 5, 6 and 7 of Circular No. 40/2020/TT-BGD&DT dated October 26, 2020 of the Minister of Education and Training stipulating codes, professional title standards, appointment and salary classification for teaching staff in public higher education institutions, when it comes into effect.

The draft Circular inherits the contents stipulated in Circular No. 40 on tasks, standards of professional ethics, standards of training and fostering qualifications and standards of expertise and professionalism of lecturers teaching in higher education institutions, ensuring consistency with relevant current legal documents; in accordance with the Party's guidelines, policies and laws of the State.

Article 13 of the Law on Teachers (Law No. 73/2025/QH15) issued on June 16, 2025, stipulates professional standards for teachers and assigns the Minister of Education and Training to promulgate professional standards for teachers.

In order to ensure consistency and synchronization with current legal documents related to teachers in educational institutions, including lecturers teaching in higher education institutions, and in accordance with the Party's guidelines, policies and the State's laws, it is necessary to develop professional standards for lecturers teaching in higher education institutions.

Lecturers proactively equip skills according to job position requirements

Resolution No. 71-NQ/TW dated August 22, 2025 of the Politburo on breakthroughs in education and training development once again affirms: learners are the center and subject of the education and training process; schools are the foundation, teachers are the driving force, deciding the quality of education and training.

Accordingly, the promulgation of professional standards for lecturers teaching in higher education institutions according to the provisions of the Law on Teachers and relevant current laws will contribute to improving the quality of education and training.

In addition, professional standards for lecturers teaching in higher education institutions are the legal basis for building, managing and developing the teaching staff in higher education institutions.

Educational management agencies and educational institutions use professional standards for lecturers in recruitment, placement, evaluation, training, and development of lecturers; and develop and implement staff development policies. Professional standards also help lecturers in higher education institutions clearly understand the standards of professional standards for lecturers in higher education institutions, clearly define training and development plans, and equip individuals with the necessary skills required by the job position they are holding.

At the same time, the draft Circular also completes the legal framework for state management agencies on education and training. Ministries, branches, localities, and higher education institutions shall implement the recruitment, use, and management of lecturers; ensuring consistency and synchronization with the system of current relevant legal documents, especially the new provisions in the Law on Teachers and in accordance with practice.

Applicable to lecturers teaching in public and non-public higher education institutions

Regulations on codes, professional title ranks, instructions on appointment and salary arrangement according to titles (principles of appointment, cases of appointment, salary arrangement of lecturers) (Articles 2, 8, 9 and 10 of Circular No. 40) are transferred to the draft Circular regulating codes, appointment and salary arrangement for teachers for teachers teaching in public educational institutions.

Circular No. 40 stipulates that the subjects of application are teaching staff in public higher education institutions. For the new draft Circular, the subjects of application are lecturers teaching in higher education institutions and related organizations and individuals, including both public and non-public. The new draft Circular does not apply to lecturers teaching in higher education institutions under the state management authority of the Ministry of Public Security and the Ministry of National Defense.

Supplementing the responsibilities of heads of higher education institutions

In addition to the duties of lecturers prescribed in Circular No. 40, according to the provisions of the new draft Circular, university lecturers, senior university lecturers are also required to perform other duties assigned by the head or head of a unit under or directly under a university education institution as decentralized according to the authority assigned in accordance with the standards on professional competence and expertise of university lecturers and other provisions of relevant laws.

The draft Circular stipulates that the head of a higher education institution or the head of a unit affiliated or directly under a higher education institution is authorized to, based on the standards of professional competence and skills of the professional standards of lecturers teaching in higher education institutions, arrange, assign, and delegate tasks to university lecturers and evaluate the level of task completion according to the professional title of university lecturers.

The head of a higher education institution or the head of a unit affiliated or directly under a higher education institution shall develop and implement a plan for training, fostering, and developing the university teaching staff according to his/her authority; advise the superior management agency and local authorities on management, fostering, and improving the quality, professional capacity, and expertise of the university teaching staff.
