Kinhtedothi - The People's Committee of Binh Phuoc province has just issued Decision No. 10/2025/QD-UBND, specifying the land area permitted for the construction of facilities directly serving agricultural production.

From March 20, 2025, people in Binh Phuoc province are allowed to construct buildings on agricultural land in accordance with regulations.

The decision will officially take effect from March 20, 2025, and will apply to agricultural land that has undergone restructuring of crop and livestock production, including rice paddy land.

The aim of the regulations is to facilitate agricultural production while ensuring that land management is carried out strictly and effectively.

According to regulations, the construction of buildings on agricultural land must strictly adhere to the following principles: ensuring that the land is used for its intended purpose, not affecting agricultural production capacity, and complying with construction regulations.

Specifically, the scale of construction on agricultural land (excluding rice paddy land) is regulated as follows:

For land plots with an area from 200,000m² to less than 300,000m²: the maximum building area is 300m².

For land plots ranging from 300,000m² to 500,000m²: the maximum building area is 400m².

For land plots exceeding 500,000 m²: the maximum building area is 500 m².

Specifically for rice-growing land, the area of ​​structures directly serving agricultural production must not exceed 500m².

Construction on agricultural land is only permitted in a single location within the plot, without the possibility of basements, and is limited to a maximum of one story. Furthermore, the construction site must be outside the safety protection corridor as stipulated in the 2024 Land Law.

This decision also emphasizes that construction must strictly comply with construction laws and related regulations. Clearly defining the area and location of construction projects not only helps to limit the misuse of land but also ensures a balance between economic development and the protection of agricultural land.

The People's Committee of Binh Phuoc province has assigned the People's Committees of districts, towns, and cities the task of directing, inspecting, and handling cases of violations. These units will be held accountable to the Provincial People's Committee if violations occur in land management within their areas.

The issuance of the new regulations is expected to create more favorable conditions for people and businesses in agricultural production, while also helping local authorities to more closely control land use.
