Specifically, according to Mr. Le Tan Can, Deputy Minister of Finance , the Ministry has received feedback on the calculation of land use fees for households and individuals when changing land use purposes from agricultural land to residential land, which has increased due to the land price on the land price list in some localities determined according to the 2024 Land Law being dramatically higher than the old land price list.
In particular, residential land prices have increased many times compared to agricultural land prices, so when the State allows the change of land use purpose from agricultural land to residential land, households and individuals must pay land use fees many times higher than before.
Faced with this situation, the Ministry of Finance has issued an official dispatch requesting localities to promptly report on the implementation of land use fee calculation when changing land use purposes for households and individuals.

In the immediate future, inheriting the 2013 Land Law, the Ministry of Finance plans to submit to the Government a plan to reduce land use fees when people convert from agricultural land to residential land in the context of land prices in some localities being suddenly higher than the old land price list.
" Adjusting land prices and land use fees on the basis of all for the benefit of people, businesses and the State, with the perspective of harmonious benefits and shared risks ," said Mr. Tan.
Recently, the Ministry of Finance also submitted a draft to amend and supplement Decree 103/2024 on land use fees, accordingly, it proposed to reduce up to 70% of land fees for households and individuals when changing land use purposes from agricultural land to residential land within the limit and reduce half of land fees outside the limit.
Accordingly, when converting agricultural land in the same plot of land with a house to residential land, the land use fee is calculated at 30% of the land use fee. For land areas exceeding the residential land allocation limit, the land use fee is calculated at 50% when converting the land use purpose to residential land. With this proposal, the amount of money households and individuals have to pay to change the land use purpose will be greatly reduced.
Regarding the additional tax payment, at the workshop, Mr. Le Tan Can said that the Ministry of Finance proposed 3 options: keeping the collection level the same, reducing the collection, and not collecting the additional payment.
The Ministry of Finance has completed and has a plan to reduce the collection level as well as the time for calculating fees after deducting the time for competent authorities to calculate land use fees.
Regarding the proposal to not collect additional tax payments, the Ministry of Finance will take note and, together with the Ministry of Agriculture and Environment, report to the Government during the process of amending the Land Law.
