Is it possible to retire early after working for more than 10 years?

(Chinhphu.vn) - Mr. Pham Manh Cuong (Dak Lak), born on March 16, 1974 (subject to Articles 1, 2, 3; not subject to Article 4 of Decree No. 178/2024/ND-CP), plans to apply for early retirement from August 1, 2025 (51 years and 4 months), has paid social insurance for 27 years.

Mr. Cuong asked, do you belong to the category of people with more than 5 years left to 10 years of retirement age as prescribed in Appendix I issued with Decree No. 135/2020/ND-CP?

Regarding this issue, the Ministry of Home Affairs responded as follows:

Pursuant to Article 4 of Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating retirement age and Article 7 of Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system (amended and supplemented in Decree No. 67/2025/ND-CP dated March 15, 2025 of the Government), retirement age is determined as the actual retirement age of the subject.

Therefore, in the case of Mr. Pham Manh Cuong, a male, born on March 16, 1974, at the time of his intended early retirement (August 1, 2025), he was 51 years and 4 months old, 10 years and 8 months short of retirement age, so he is not subject to the provisions of Article 7 of Decree No. 178/2024/ND-CP (amended and supplemented by Decree No. 67/2025/ND-CP dated March 15, 2025 of the Government ).
