Prime Minister's telegram on removing difficulties in land management, use, land allocation, and land valuation

The Prime Minister directed to remove difficulties in implementing land management, land use, land allocation and land valuation.

The telegram issued on October 13, 2023 to the Ministers of the Ministries of Natural Resources and Environment, Agriculture and Rural Development, Planning and Investment, Finance, Construction, Justice, Information and Communications; the Government Inspector General and the Chairmen of the People's Committees of the provinces and centrally run cities clearly stated:

Recently, the Government and the Prime Minister have issued many documents directing ministries, branches and localities to urgently resolve difficulties and obstacles in land management and use, land valuation, granting certificates of land use rights, house ownership rights and assets attached to land, and simplifying administrative procedures in the land sector. However, through direct feedback from people, businesses, public opinion in the press and discussions with localities, the implementation of the Government and the Prime Minister's instructions is still slow and not resolute. In order to promptly remove difficulties and obstacles, clear up and promote land resources, promote the implementation of socio -economic development projects, remove difficulties for the real estate market, ensure the legitimate and legal rights and interests of people and businesses, the Prime Minister requests:

1. The Minister of Natural Resources and Environment urgently:

a) Listen to, study, and absorb opinions from localities, organizations, associations, businesses, and individuals participating in the process of finalizing the Draft Amended Land Law, so that the provisions of the Amended Land Law, when promulgated, come into effect; regulations must be clear, transparent, easy to understand, easy to implement, easy to monitor and inspect; increase decentralization and delegation of authority in land allocation, land lease, and change of land use purpose; increase personal responsibility of leaders, while promoting inspection and supervision work, absolutely not causing trouble for people and businesses, meeting practical requirements.

b) Before October 25, 2023, submit to the Government for consideration and promulgation a Decree amending and supplementing Decree No. 44/2014/ND-CP dated May 15, 2014 in a scientific and practical manner, simplifying procedures, minimizing intermediate steps, providing clear, easy-to-understand regulations, convenient for implementers and not causing loss of state budget when conducting land valuation, deciding on land prices, not allowing negative corruption and not being afraid of mistakes, afraid of responsibility, not daring to do.

c) Before October 31, 2023, submit to the Prime Minister a study to adjust the National Land Use Planning indicators for the 2021 - 2030 period, with a vision to 2050, and the 5-year national land use plan for 2021 - 2025 that have been allocated to localities in Decision No. 326/QD-TTg dated March 9, 2022 to meet the land use needs of localities to implement projects and works for socio-economic development, unlock resources, and restore the economy in the coming time.

d) Guide localities in implementing the work of granting certificates of land use rights, house ownership rights and assets attached to land according to the principle of simplifying procedures, not causing inconvenience or harassment to people and businesses during the implementation process.

e) Develop specialized inspection and surprise inspection plans within the authority to prevent, stop, and correct land-related violations in ministries, branches, and localities.

2. Chairman of People's Committee of provinces and centrally-run cities:

a) Focus on directing land valuation and deciding on land prices within authority, following the direction of the Government in Resolution No. 73/NQ-CP dated May 6, 2023, without causing difficulties, delays, or affecting the progress of investment project implementation to unlock resources and promote socio-economic development.

b) Direct the provincial natural resources and environment agency to carry out administrative procedures for granting certificates of land use rights, house ownership rights and assets attached to land, and changing land use purposes for organizations and people quickly and in accordance with regulations; rectify discipline, order, and public ethics of officials and civil servants in the process of implementing and resolving administrative procedures related to land.

c) Review and evaluate the results of implementing the province's land use targets allocated by the Prime Minister; propose land use needs to ensure effective and economical land exploitation and use in accordance with regulations; and not cause waste of land resources.

3. Ministers of the Ministries of Agriculture and Rural Development, Justice, Finance, Construction, Planning and Investment, Information and Communications, Government Inspectorate and relevant Ministries and branches shall proactively coordinate closely with the Ministry of Natural Resources and Environment to promptly guide localities to remove difficulties and obstacles related to land management and use, land valuation, issuance of certificates of land use rights, house ownership rights and assets attached to land according to assigned functions, authorities and current regulations.

4. Assign Deputy Prime Minister Tran Hong Ha to directly direct the Ministers and Chairmen of the People's Committees of provinces and centrally run cities to be responsible to the Prime Minister in organizing, implementing, urging, inspecting and promptly handling the difficulties of people and enterprises reflected and proposed by provinces and centrally run cities according to this Official Dispatch.

5. The Government Office monitors, advises and urges relevant ministries, agencies and localities to effectively implement this Official Dispatch, and promptly reports to the Prime Minister any problems and difficulties in the implementation process./.
