(NDLO) - The Traffic Police Department believes that the information "Decree 168 was built with incorrect procedures because from the date of signing to the date of taking effect, it was less than 45 days" is incorrect.
On January 12, the Traffic Police Department (Traffic Police, Ministry of Public Security ) said that in recent days, social networks have been spreading information that "Decree 168/2024/ND-CP was built with incorrect procedures because from the date of signing to the date of taking effect, it has not been 45 days", this is incorrect information.

Accordingly, Decree 168/2024/ND-CP stipulates administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points and restoration of driving license points. This Decree was signed and issued on December 26, 2024, effective from January 1, 2025.
According to the representative of the Traffic Police, during the process of drafting Decree 168 to replace Decree 100/2019 (amending and supplementing Decree 123/2021), due to the urgent nature related to the traffic safety and order situation, the competent authority held meetings to consider and decide to issue the decree according to the shortened procedure. Article 151 of the Law on Promulgation of Legal Documents stipulates that legal documents issued according to the shortened procedure can take effect from the date of adoption or signing.
Meanwhile, Decree 168/2024 aims to serve the enforcement of the Law on Road Traffic Order and Safety (effective from January 1, 2025). In addition to increasing the level of punishment for many intentional and dangerous acts, the Decree also clearly stipulates the deduction of driving license points as stipulated in the law.
"After about 5 years of implementing Decree 100/2019, in reality, factors have arisen that require more appropriate legal regulations to ensure traffic order and safety," said a representative of the Traffic Police.
According to the representative of the Traffic Police, due to the great impact of the decree, to ensure quality, the functional units of the Ministry of Public Security have coordinated with relevant ministries, branches and agencies to discuss thoroughly. Along with that, the draft decree was also posted and widely received comments according to regulations on the electronic information portal of the Ministry of Public Security and the Government electronic information portal.
