General Phan Van Giang stated that it is appropriate not to differentiate between men and women in the military and not to stipulate a roadmap to increase the maximum service age for female officers with the rank of colonel.

According to the program this morning (November 5), the National Assembly will discuss the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army. Before that, General Phan Van Giang - Minister of National Defense - reported on receiving and explaining the opinions of delegates at the group discussion session.

Currently, the entire army has one female officer with the rank of Major General.

Accordingly, there are opinions suggesting to differentiate the age between male and female colonels and generals; to stipulate a roadmap for increasing the age similar to the Labor Code. Regarding this issue, the drafting agency said that currently, the number of female officers accounts for a low proportion (about 3% compared to the total number of officers ). They mainly work in agencies, academies, schools, hospitals, scientific research institutes (centers), cultural and artistic units... (there are no female officers commanding combat units). Every year, only female officers are recruited and trained at military medical, logistics, military engineering, and military science academies. A few are selected and promoted to officer ranks to be assigned to specialized fields that the military cannot train or can train but are still lacking compared to the payroll. Female officers are assigned to positions suitable for their health and gender and are cared for and given conditions to have time to take care of their families. Minister Phan Van Giang stated that according to the roadmap for increasing the retirement age, the retirement age of female workers in 2024 will be 56 years and 4 months, then increase by 4 months each year, until 2029 it will be 58 years old, and 2035 it will be 60 years old.
Currently, the age limit for serving in the army for female officers of the rank of lieutenant colonel or below (mainly officers with high professional qualifications such as associate professor, doctor, specialist II..., specialized and specialized training) as stipulated in the draft law is still lower than the retirement age of female workers, so there is no need to stipulate a roadmap for increasing the age. For female officers of the rank of general and colonel, General Phan Van Giang informed that currently the entire army has 1 rank of major general (associate professor, doctor of medicine) and about 2% of female officers of the rank of colonel compared to the total number of officers of the rank of colonel. They mainly work in strategic agencies, academies, schools, scientific research centers, hospitals, cultural and artistic units and have high qualifications (associate professor, doctor, specialist II, people's artist, meritorious artist), basically belonging to the subjects of extending the term of service in the army for 5 years as stipulated in the draft law. The highest age among female colonel-level officers is currently 13 officers 53 years old, so by 2029 it will be 58 years old, in line with the retirement age prescribed by the Labor Code. In practice, since the establishment of the Vietnam People's Army, the Army has only had 7 female general-level officers, of which 4 are PhDs and doctors (at the highest, there were 3 female general-level officers working together, currently only 1 is working). Therefore, General Phan Van Giang stated that the draft law does not distinguish between men and women in the military and does not stipulate a roadmap to increase the maximum service age for female officers with the rank of colonel, which is in line with reality. This issue has been agreed upon by the Government and the Central Committee of the Vietnam Women's Union.

Minimum remaining service time for promotion from colonel to major general

The report clearly stated that some opinions suggested that the minimum remaining time to consider promotion from the rank of colonel to major general, rear admiral of the Navy must have at least 5 years of service, must be 57 years old. At the same time, it was proposed to revise the content "in case of not having enough 3 years of service when there is a request, the President will decide" to "in case of not having enough 3 years of service but the organization has a need, the President will decide". Regarding this issue, the drafting agency stated that it originated from the requirements of the task of protecting the Fatherland, building the army and was consistent with the Party's regulations on appointing cadres. When there is a case of not having enough 3 years of service, but according to the requirements of the task, the Central Military Commission will consider the report according to the process to the President for decision. At the same time, it is stipulated as a draft law to be consistent with the Law on People's Public Security. Based on the opinions of delegates, the drafting agency will continue to study and revise the draft law to make it suitable and feasible.
