Fight against counterfeiting and protect brands

In order to prevent counterfeit, fake, and poor quality goods that affect the health and interests of consumers, and contribute to protecting the brand of reputable manufactured goods, the market management force always makes efforts in implementing solutions to direct and manage the market in localities and on freight transport routes in the area.

 

On the occasion of Anti-Counterfeiting and Counterfeiting Day (November 29), Phu Yen Newspaper discussed with Mr. Nguyen Thai Vinh, Deputy Director of Phu Yen Market Management Department about related issues. Mr. Nguyen Thai Vinh said:

- Since the beginning of the year, production, trading and transportation of goods in the province have continued to be maintained. E-commerce activities, online business through social networking platforms Zalo, Facebook, express delivery services, postal services... have developed strongly. Food, foodstuffs, essential goods at markets, stores, supermarkets... are displayed with a variety of types and designs; prices are relatively stable, and the quantity also meets the shopping and consumption needs of the people.

 

* How has the situation of counterfeit goods been in the area recently and how has the market management force controlled and handled it, sir?

 

- In reality, besides branded, quality goods, there are still potential counterfeit, fake, poor quality goods of unknown origin on the market. These goods are often cheap, because some small traders mix them with genuine goods to profit and deceive consumers. This is one of the issues that society and consumers are concerned about.

 

Implementing the direction of the National Steering Committee 389, the General Department of Market Management, the Provincial People's Committee, the Provincial Steering Committee 389, from the beginning of the year, the Phu Yen Market Management Department has directed its market management teams to closely monitor the area, detect and strictly handle acts of buying, selling, and transporting counterfeit goods, goods that violate intellectual property rights, etc.

 

Since the beginning of the year, the market management force has inspected and handled 13 cases, imposed administrative fines of over VND100 million; confiscated and destroyed infringing goods with a total value of over VND120 million; and transferred a case of buying and selling counterfeit Mango branded clothes with a quantity of 590 pieces with a total value of VND531 million to Tuy Hoa City Police for investigation and handling according to the provisions of law.

According to the assessment, the infringing goods are mainly fake Honda and Yamaha motorcycle spare parts, or clothes, shoes, handbags, cosmetics... that are fake or imitate famous brands. For example, in November, the market management force coordinated with relevant units to inspect, detect and temporarily detain 155 pieces of clothing and men's wallets without invoices or documents, showing signs of counterfeiting Louis Vuitton and Burberry trademarks; detected and temporarily detained 81 Honda and Yamaha motorcycle spare parts products showing signs of counterfeiting trademarks that are protected in Vietnam...

 

* To prevent this problem, what immediate and long-term solutions need to be implemented?

 

- The fight against smuggling, trade fraud and counterfeit goods in the province is always strictly controlled. The work of preventing, combating and suppressing all types of crimes as well as inspecting and controlling the market is also strengthened.

 

The functional forces that are members of the Provincial Steering Committee 389 in general, and the market management force in particular, have made efforts to implement plans, proactively coordinate to organize propaganda, thoroughly grasp, and synchronously implement professional measures, in order to firmly grasp and closely manage the local situation, promptly detect and handle violations.

 

In handling violations related to counterfeit and fake goods, Phu Yen Market Management Department and local authorities always closely follow the specific contents and regulations in Decree 99/2013/ND-CP of the Government regulating administrative sanctions for violations in the field of industrial property; Decree 126/2021/ND-CP amending and supplementing a number of articles of the decrees regulating administrative sanctions for violations in the fields of industrial property, standards, measurement... and Decree 46/2024/ND-CP amending and supplementing a number of articles of Decree 99/2013/ND-CP.

 

Along with that, we also actively propagate and disseminate laws related to commercial activities so that organizations, businesses and individuals can produce and trade in goods of good quality, beautiful designs, reasonable prices, suitable for market demand; regularly review legal documents, create a better legal corridor in the work of preventing and combating smuggling, counterfeit goods, fake goods and poor quality goods.

On the occasion of the Anti-Counterfeit Goods Day, the Phu Yen Market Management Department opened the Genuine and Counterfeit Goods Showroom at its headquarters (Nguyen Van Linh Street, Phu Lam Ward, Tuy Hoa City) during office hours for consumers to visit, learn about, and identify genuine and counterfeit goods; at the same time, it communicates and advises consumers to prevent and detect counterfeit goods, and not to assist in the buying and selling of counterfeit, fake, and poor-quality goods. The Phu Yen Market Management Department recommends that consumers buy goods at reputable places with specific addresses; when buying any product, they must check the information on the label, see the production date, expiration date, etc. The unit hopes that people will continue to raise awareness, be vigilant, and resolutely fight against counterfeit and counterfeit goods.

 

In the coming time, Phu Yen Market Management Department will continue to coordinate with localities, businesses and establishments to organize signing of commitments not to trade in counterfeit, poor quality goods, or goods of unknown origin.

 

The unit also increases information exchange and coordinates with all levels, sectors and localities to control, detect and promptly handle violators and violations.

 

The Department continues to direct its affiliated units to step up the fight against counterfeit and fake goods; proactively search for and detect counterfeit goods and prevent the production and trade of counterfeit and fake goods, helping businesses and establishments protect their product brands, contributing to building a healthy commercial environment in the area.
