According to the Investigation Conclusion, the defendant Tran Qui Thanh, his two daughters and a number of others took advantage of the lending regulations, charging an interest rate of 3% per month - below the level that constitutes the crime of usury. When lending, Tran Qui Thanh did not make a loan contract with collateral, but forced businesses and individuals to make a contract to transfer projects and shares in the project. The value of the projects and real estate in the contract was many times lower than the actual value.

According to the Investigation Agency, when the borrower completed the procedures to transfer the property to Tan Hiep Phat, Mr. Thanh directed his two daughters to complete the procedures to transfer the property to his name in order to take control and dispose of the property. Although the borrower had fulfilled the obligation to fully pay the principal and interest as agreed, Mr. Thanh still used deceitful tricks or created reasons to intentionally not return the property and appropriate the property.

Using the above tricks, from January 2019 to November 2020, the three father and sons of Tan Hiep Phat Group's Chairman appropriated assets, projects, and land plots of a number of individuals.

Compared to the Investigation Conclusion in October 2023, the Ministry of Public Security's Investigation Police Agency maintained its stance on prosecuting the three defendants, but the amount of money misappropriated was determined to have increased from VND 767 billion to VND 1,048 billion.

Previously, the Ministry of Public Security assigned the Ministry of Public Security's Investigation Police Agency (C01) to investigate, verify, and resolve the content of the petitions of a number of citizens in Ho Chi Minh City and Dong Nai province accusing Mr. Tran Qui Thanh and his daughters Tran Uyen Phuong, Tran Ngoc Bich and a number of other individuals of committing the acts of "Fraudulent appropriation of property"https://dangcongsan.vn/thoi-su/,"Abuse of trust to appropriate property"https://dangcongsan.vn/thoi-su/,"Tax evasion"https://dangcongsan.vn/thoi-su/,"Extortion of property" are projects and real estate of particularly large value in Dong Nai province and Ho Chi Minh City since November 2020.

On April 10, 2023, the Ministry of Public Security's Investigation Police Agency prosecuted Tran Qui Thanh, Tran Uyen Phuong, and Tran Ngoc Bich of Tan Hiep Phat Trading and Service Company Limited. The investigation agency said that during the investigation, there was sufficient basis to determine that the actions of Mr. Tran Qui Thanh and his daughters, Tran Uyen Phuong and Tran Ngoc Bich, constituted the crime of "Abuse of trust to appropriate property"./.
