Proposed land support policy for ethnic minorities

About land allocation limit:

a) For community living land: Ethnic minority communities are allocated community living land with a minimum area of ​​100m2 and a maximum of no more than 2,000m2 .

b) For residential land: Individuals receiving support under the provisions of Clause 2, Article 16 of the Land Law shall have the maximum land allocation limit not exceeding the land allocation limit prescribed in Clause 1, Article 8 of Decision No. 28/2024/QD-UBND dated October 19, 2024 of the Provincial People's Committee.

c) For agricultural land: Individuals receiving support under the provisions of Clause 2, Article 16 of the Land Law shall have the maximum agricultural land allocation limit not exceeding the agricultural land allocation limit under the provisions of Article 176 of the Land Law.

d) For non-agricultural land that is not residential land for production and business: Depending on the actual situation, customs and local land fund, the District People's Committee shall decide to lease land to individuals for each specific case to implement the land support policy according to the provisions of this Resolution.

About support content:

a) For community land: Ethnic minority communities that do not have land for community activities will be allocated land funds suitable to the customs, practices and culture of each ethnic group and each locality and will be fully supported with costs for surveying, establishing cadastral records and fees for granting certificates of land use rights and ownership of assets attached to land.

b) For residential land: In addition to the policy of exemption and reduction of land use fees as prescribed in Clause 1, Article 18, Clause 1, Article 19 of Decree No. 103/2024/ND-CP dated July 30, 2024 of the Government , individuals receiving residential land support as prescribed in this Resolution shall be supported with all costs for surveying, preparing cadastral records and fees for granting certificates of land use rights and ownership of assets attached to land.

c. For agricultural land: Individuals who are allocated agricultural land when implementing the land support policy under this Resolution will be supported with all costs for surveying, preparing cadastral records and fees for granting certificates of land use rights and ownership of assets attached to land.

d. For non-agricultural land that is not residential land for production and business: In addition to the policy of exemption and reduction of land rent as prescribed in Articles 39 and 40 of Decree No. 103/2024/ND-CP dated July 30, 2024 of the Government, individuals who are supported for non-agricultural land that is not residential land for production and business as prescribed in this Resolution shall be supported with all costs for surveying, preparing cadastral records and fees and charges for granting certificates of land use rights and ownership of assets attached to land.
