Proposal to promote decentralization, delegation of power, and abolish unnecessary procedures

According to the Ho Chi Minh City Department of Home Affairs, in order for Resolution 66 to truly create change, the City needs to continue to decentralize more strongly to the grassroots level; at the same time, abolish unnecessary procedures when electronic data is available, in order to save costs and serve people more conveniently.

On October 7, comrade Nguyen Van Tho, member of the Standing Committee of the City Party Committee, Permanent Vice Chairman of the Ho Chi Minh City People's Committee chaired a working session with the Department of Justice and related units to listen to a report on the progress of implementing Resolution No. 66-NQ/TW of the Politburo on innovation in law-making and enforcement, meeting the requirements of national development in the new era.

Research on software to monitor the progress of promulgating legal documents

According to the Ho Chi Minh City Department of Justice, by September 23, the City had established a more basic and clear legal framework for law-making and enforcement; at the same time, it had strengthened the responsibility of each agency and unit in organizing implementation. To date, 68 units have issued plans to implement Resolution 66, including 9 departments, branches, and 59 People's Committees of communes and wards.

Notably, the current law-making work is carried out according to a special mechanism stipulated in Resolution No. 197/2025/QH15 of the National Assembly , in which the expenditure level for each draft legal document is significantly increased. This approach aims to encourage officials and civil servants to improve their professionalism, ensure the quality of content, and ensure strict and correct procedures for issuing documents.

A representative of the Department of Justice said that, according to preliminary statistics, Ho Chi Minh City currently has 393 new legal documents (including documents of Ba Ria - Vung Tau and Binh Duong provinces before) that have been reviewed, but there are still 1,110 documents that have not been reviewed. The issuance of the list of documents of the People's Council and People's Committee is still slow. Therefore, the Department of Justice recommends that the City leaders direct units, especially at the ward and commune levels, to strengthen coordination with the Department to unify and systematize documents, ensure consistency and avoid overlap.

The agency also proposed that the City maintain regular thematic meetings on law-making; research and develop software to monitor the progress of promulgating legal documents so that leaders can easily grasp them; and at the same time, pay attention to building a team of specialized and more in-depth cadres and civil servants in the legal field.

On the side of the Ho Chi Minh City Department of Home Affairs, the department representative shared that Resolution 66 is a special step forward when the General Secretary directly serves as the Head of the Central Steering Committee, so localities also need to have corresponding Steering Committees to ensure unity and synchronization. The Department of Home Affairs recognizes that this is an opportunity for the City to continue to make institutional breakthroughs, especially in decentralization and delegation of power.

According to the representative of this department, to implement Resolution 66 with a real breakthrough, the City needs to review all administrative procedures, and propose to abolish unnecessary procedures, especially in the field of notarization and certification. For example, many types of documents currently require people to have them notarized, while electronic data can completely replace them. If it can be reduced, it will reduce costs for the State, make it more convenient for people, and at the same time create the premise for a more open and innovative legal system.

At the meeting, representatives of departments and branches discussed and identified difficulties and obstacles, and proposed many solutions to remove "bottlenecks" in law-making work.

Speaking at the meeting, comrade Nguyen Van Tho, member of the Standing Committee of the City Party Committee, Permanent Vice Chairman of the Ho Chi Minh City People's Committee, requested agencies and units to continue implementing Resolution No. 66 with the highest sense of responsibility.

Comrade Nguyen Van Tho emphasized that after the merger, Ho Chi Minh City will have the position of a super city, the locomotive of development of the whole country, so the work of building and enforcing laws is of special importance.

Departments, branches and localities need to proactively coordinate with the Department of Justice to research, develop and propose specific regulations and mechanisms suitable for the city. In that process, it is necessary to fully absorb comments from agencies, units and people, ensuring consistency and unity among the three localities after the merger.

The Standing Vice Chairman of the Ho Chi Minh City People's Committee requested that there should be no delays or omissions in advising and issuing legal documents. Heads of departments, branches and sectors must promote a high level of responsibility, considering this a key task, and absolutely not allow mistakes to occur.

Departments and branches must approach professional issues early, proactively advise the City People's Committee; at the same time review and perfect the policy system, especially specific policies that are still different between the three localities before.

In addition, promote training and fostering of legal staff, assign the Department of Justice to coordinate with the Department of Home Affairs to synthesize and evaluate the capacity of the judicial staff at departments, branches and localities.

Pay attention to working conditions and technology application, ensuring effective digital transformation in law-making. In the immediate future, it is necessary to build a data center on the legal document system so that units can access, share, and manage it uniformly.
