On July 17, the Ministry of Education and Training held a professional consultation workshop on some contents guiding the implementation of the Law on Teachers, policies for teachers, educational leaders and school personnel in the new context.
Sharing at the workshop, Mr. Nguyen Van Phong, Deputy Director of the Departmentof Education and Training of Ho Chi Minh City, said that when implementing two-level local government, the tasks, powers and recruitment responsibilities of the Department of Education and Training and the People's Committees at the commune level are still not consistent.
According to Decree 142 issued on June 12, regulating the authority of two-level local authorities, the Department of Education and Training has the right to recruit, manage, use, and appoint teachers, civil servants, and employees in public educational institutions in the province.
According to the Law on Organization of Local Government (Law 72/2025) issued on June 16, the Chairman of the People's Committee at the commune level is responsible for recruiting, appointing, and managing civil servants and public employees in the area.
Mr. Phong informed that when implementing the two-level local government, Ho Chi Minh City has 168 communes/wards. According to statistics, there are many communes/wards that only have one primary school and one secondary school. Specifically, there are 4 communes/wards that only have one primary school, 19 communes/wards that only have one secondary school.
"If the responsibility of rotating management staff, mobilizing and appointing them is assigned to the People's Committee at the commune level, it will be very difficult, because many communes/wards only have one school and have no place to rotate. Meanwhile, the regulation on rotating management staff is 5 years for one term and no more than two terms at one work unit," said Mr. Phong.
Regarding the recruitment of teachers and civil servants, according to him, in the early stages of implementing two-level local government, many communes/wards did not have civil servants in the education sector, and the social and cultural departments of the communes/wards also did not have civil servants in the education sector.
Therefore, if the appointment and recruitment of teachers is assigned to the commune level, it will be very difficult.
Similarly, Mr. Dinh Ngoc Son, Deputy Director of the Department of Education and Training of Quang Ninh , said that when switching to a two-level government, Quang Ninh province also encountered difficulties in mobilizing and rotating teachers.
Besides, according to Mr. Son, when implementing two-level local government, Quang Ninh province has 54 new commune-level units, but more than half of the communes' social and cultural departments do not have people in the education sector to advise on education in the area.
From the above problems, Mr. Nguyen Van Phong proposed two contents:
Firstly, regarding the appointment work, for schools under the People's Committee of the commune level, the appointment is made by the Chairman of the People's Committee of the commune level but must have the opinion of the Department of Education and Training. The Department of Education and Training can participate in the mobilization of management officials according to the inter-zone and inter-ward levels, creating favorable conditions for communes and wards with few school units.
Second, in the recruitment work, he said, the Department of Education and Training should be assigned to take the lead in recruiting into the industry. The Department of Education and Training will organize the recruitment or issue a handover document, assigning the right to recruit directly to the heads of schools that meet the recruitment conditions.
"When the Department of Education and Training is assigned the right to recruit, the department will organize training for units, approve recruitment plans, recognize results, and monitor the recruitment process of units in accordance with Government regulations," he said.
According to the provisions of the Law on Teachers, heads of public vocational education institutions and public universities, regardless of the level of autonomy granted, have the right to take the initiative in recruiting teachers.
Currently, the Ministry of Education and Training is drafting a circular regulating the authority to recruit teachers in preschool, general education, and continuing education institutions, to be submitted to the Government in November 2025.
