Proposal to decentralize the authority to decide on approving standards and specialized equipment that are medical equipment

(Chinhphu.vn) - The Ministry of Health is drafting a Circular decentralizing the authority to decide on approving standards and norms for the use of specialized machinery and equipment that are medical equipment of agencies and units under the management of the Ministry of Health.

According to the Ministry of Health , previously, implementing Decision No. 50/2017/QD-TTg of the Prime Minister stipulating standards and norms for the use of machinery and equipment, the Ministry of Health issued Decision No. 2316/QD-BYT dated June 4, 2020 decentralizing the authority to decide on the approval of standards and norms for the use of specialized machinery and equipment of agencies and units under the management of the Ministry of Health; in which the Ministry of Health approves standards and norms for the use of specialized machinery and equipment (specialized medical equipment) and decentralizes the approval authority to units to proactively decide on the approval of standards and norms for the use of other specialized machinery and equipment of the unit (except for special specialized medical equipment).

Pursuant to the provisions of the Law on Government Organization and the Law on Promulgation of Legal Documents, the Ministry of Health has drafted a Circular regulating the decentralization of authority to decide on approval of standards and norms for the use of specialized machinery and equipment , which are medical equipment, of agencies and units under the management of the Ministry of Health.

The drafting of the Circular aims to implement the Party and Government's policy on strengthening decentralization of authority, granting autonomy and self-responsibility to units; based on the functions, tasks and scope of management of the Department of Infrastructure and Medical Equipment, the Department proposes to decentralize the entire authority of approving standards and norms for the use of specialized machinery and equipment, which are medical equipment of agencies and units under the management of the Ministry of Health to units so that the units can proactively decide according to regulations.

Content of authority decentralization

The draft Circular clearly states that the scope of application is public service agencies and units under the management of the Ministry of Health and the authority to decide on approval of standards and norms for the use of specialized machinery and equipment that are medical equipment of the Ministry of Health.

Content of authority decentralization : Decentralization of authority to the Management Board (in case the unit has a Management Board), the head of the unit that self-insures regular expenses, the unit that partially self-insures regular expenses and the unit whose regular expenses are guaranteed by the State under the Ministry of Health, decides to approve the standards and norms for the use of specialized machinery and equipment that are medical equipment at the unit.

The Ministry of Health is seeking comments on this draft on the Ministry's Information Portal.
