The draft resolution of the Government to remove difficulties and obstacles arising in the process of implementing planning work according to the Law on Planning (applicable to national planning, regional planning, provincial planning and related contents of approval, adjustment and implementation of planning for the period 2021 - 2030) has just been sent by the Ministry of Finance to the Ministry of Justice for appraisal.
Regarding the use of previous planning content, the draft regulation stipulates that in case the planning for the 2021 - 2030 period has not been approved or adjusted, the content from previous planning will be considered for use if it is still suitable; not contrary to the development policies and orientations approved by competent authorities.
In case of planning adjustment but not changing the main objective, it is allowed to apply the shortened order and procedure. It is not required to consult again with the agencies and organizations that have agreed if the content of the adjustment remains unchanged.
During the time the new planning has not been completed, the project investment policy can still be approved, but it must be ensured that there is no conflict in the development space.
Regarding investment projects, the draft allows determining the location, scale, and preliminary capacity of the investment project based on the old planning or existing orientation documents. During the time when there is no new planning, the competent authority can still approve the investment policy if the project meets the requirements of not affecting the connectivity of sectors and fields; and does not conflict with the development space orientation.
The draft also encourages localities to combine and integrate planning contents to reduce costs and increase consistency.
The temporary regulations set out in the draft apply during a transitional period, while the new planning system is not yet complete.
