What should businesses do to combat counterfeit goods?

According to Mr. Do Hong Trung, the situation of criminals using digital technology to trade in counterfeit goods poses unpredictable dangers, requiring the synchronous participation of authorities at all levels, enforcement forces, businesses, and consumers to prevent it.

In particular, he suggested that businesses should proactively implement measures to protect products such as registering trademarks, designs, patents, etc. at competent domestic and foreign authorities if they have international trade activities, and using high-tech anti-counterfeiting stamps such as QR codes, holograms, NFC, RFID, and security barcodes.

Exclusive packaging design, periodically changed and with unique identification features, applying digital technology to identify, authenticate, and encode product information. Controlling the supply chain, general agents, distributors, selecting reputable distributors and agents, committing to not trading in counterfeit goods, attaching product codes and positioning systems during transportation.

Warn and guide consumers to distinguish genuine and fake products, publicize information about genuine products; encourage people to report and provide counterfeit products and products with intellectual property infringement to businesses and enforcement forces. At the same time, coordinate with competent authorities to verify and handle according to regulations; implement other legal measures such as warning and suing against infringed or counterfeit products.

For associations and industries, Mr. Do Hong Trung suggested that representatives of members coordinate with economic organizations and enforcement agencies to fight against counterfeit goods, goods that infringe on intellectual property rights, and protect business brands more actively and effectively.

Proactively search for and share information with authorities about subjects that produce, trade, transport, store and trade counterfeit goods, infringe intellectual property rights, affecting member businesses in particular as well as violating Vietnamese law in general for handling according to legal regulations.

Tighten the responsibility of e-commerce platforms

According to Mr. Do Hong Trung, e-commerce platforms play an intermediary role connecting sellers and buyers, so they have a great responsibility in controlling and preventing counterfeit goods and intellectual property infringement to ensure a transparent and reputable business environment.

Accordingly, e-commerce platforms need to build a mechanism to control sellers, carefully assess seller information, require business licenses, ID cards, tax codes, business locations, places of residence, temporary residence and other related documents. Review products before posting based on descriptions, images, and certificates if the products are in the group with high risk of counterfeiting (cosmetics, functional foods, pharmaceuticals, electronics, fashion, etc.).

At the same time, improve the application of counterfeit detection technology, such as using automatic scanning systems to detect similar products but with questionable prices or brands that compare product data with a list of registered genuine brands, combined with blockchain or product identifiers for traceability.

Using AI tools/automatic algorithms to detect keywords or signs of counterfeit goods (too cheap prices, fake brand names, etc.), monitoring public opinion and responding to customers with AI helps to detect negative reviews early, reporting counterfeit goods from customers so that businesses or authorities can handle them promptly.

Mr. Do Hong Trung also suggested that e-commerce platforms classify sellers according to reliability and brand (genuine shops, regular shops...), support buyers in identifying them, have strict handling mechanisms such as locking accounts, removing products, imposing fines or public announcements if violations are detected, and forwarding information to authorities for investigation and handling. Coordinate with rights holders and trademark owners to prioritize control of counterfeit goods.

“E-commerce platforms must regularly review and remove infringing products when receiving warnings from third parties or the genuine product, and must also take joint responsibility if there are no measures to control counterfeit goods and goods that violate intellectual property rights,” said Mr. Do Hong Trung.
