Hope the new province inherits the approval of the old province
The merger of provinces and communes initially affects the implementation of projects in localities. For example, the merger of the old provinces of Hoa Binh , Vinh Phuc, Phu Tho to form the new Phu Tho province, enterprises are bidding for land for projects in the old Hoa Binh province, expected to open bidding on July 4.
When submitting bidding documents, enterprises submitted them in Hoa Binh province. Now that Hoa Binh province no longer exists, enterprises do not know how the bidding process will be transferred, who will be the next project manager, and who will be the bid judge.
Enterprises are struggling to know which mechanism will be used to transfer the project implementation, whether to submit bidding documents in Hoa Binh or Phu Tho .
Another issue is the transfer of legal documents. For example, if a company is implementing a project in locality A, when it moves to locality B, will the new province review the legal documents for project implementation? Because the company has been following the planning of the old province for a long time, there is concern that the planning may change when it moves to the new province.
In addition, regarding the focal point for handling work, each province and city has different working regulations. Now that the provinces have merged, businesses do not know which unit they will have to work with next. For the same real estate project, province A assigns the Department of Construction to manage and organize the bidding to select investors, but province B assigns the project management board, and province C assigns the Department of Finance. Project management staff can also change, so businesses are initially somewhat "confused".
We recommend: Regarding the focal point of work, the new provinces after the merger must clearly announce it right from the beginning of operation. There should be early guidance documents for businesses to know and implement.
Second, enterprises doing housing and real estate projects want to transfer all legal documents related to the project from the old province to the new province. Because if they stop, review, and require to start over from the beginning, the enterprises will suffer great losses and risk "going bankrupt". The procedures related to the project have been approved by the old province, so the new province needs to inherit them to continue implementing the project.

Expect public disclosure of specific guidelines
In the current transition period, there are major changes in the focal point, the individual handling the work, and the authority to handle it. Not only the real estate sector but also many other sectors in the past time, the management agencies have been busy restructuring the organization, so they have not yet handled the procedures for businesses.
This has been happening for the past few months when merging ministries and branches, and now provinces and communes. This is understandable because streamlining the apparatus is a big revolution. I just hope that the management agencies will soon stabilize to support businesses and people on the principle of handling transitions, not retroactively what has been approved before.
To facilitate businesses and people coming to carry out investment and business procedures, it is recommended that before closing, old agencies should publicly announce which new agencies will handle the next procedures. New agencies established after merging provinces and communes should also publicly announce information about which procedures they will handle for easy implementation.
Still have some "hesitations"
Speaking to Tuoi Tre on July 1, Mr. Nguyen Van Thu, Chairman of the Board of Directors of GC Food Company, said that the unit has informed its partners about the change of new address, the packaging has also been updated with the new address so it is basically going smoothly. However, there are some procedures related to land registration, certification for bank loans, related procedures... that are currently "uneasy".
"Previously, land in a province was notarized in that province, but now that the merger has been completed, I don't know if there will be any changes. For example, if you have land in Ba Ria - Vung Tau and want to borrow from a bank, will the documents and records be notarized in the old province or must you go to Ho Chi Minh City?", said Mr. Thu.
