Focus on implementing housing and land policies

More than 100 contents of the Land Law, 64 contents of the Housing Law and 22 contents of the Real Estate Business Law need to be regulated in sub-law documents to be able to synchronously implement housing and land policies decided by the National Assembly .

Both much and difficult

From January 1, 2025, all three laws on Land, Housing and Real Estate Business will come into effect. This is an opportunity to remove bottlenecks in areas that are very important to economic recovery. However, how to take advantage of this opportunity depends largely on the implementation of new policies of these three important laws.

Last week, at the second National Conference to implement the laws and resolutions of the 6th Session and the 5th Extraordinary Session of the 15th National Assembly, both National Assembly Chairman Vuong Dinh Hue, National Assembly Vice Chairman Nguyen Khac Dinh and other opinions emphasized the need to bring new policies on land and housing into life in a synchronous manner.

“At the 6th Session and the 5th Extraordinary Session, the 15th National Assembly passed 9 important laws and 11 resolutions, which have a profound impact on society and the country's macroeconomic policies, and are significant not only for the implementation of the socio-economic development plan for 2024 and 2025, but also for the fundamental, strategic, and long-term significance in the next period. In particular, with the passage of the Land Law, the National Assembly has completed one of the most important legislative tasks of the term,” National Assembly Chairman Vuong Dinh Hue summarized.

According to the National Assembly Chairman, the quality of the laws and resolutions after their promulgation initially received consensus and high appreciation from the people, voters, compatriots abroad and the domestic and foreign business community. However, he also noted that the amount of work needed to implement the law is very large when the content assigned to the Government and regulatory agencies is both numerous (nearly 400 contents), difficult and demanding in terms of progress. In particular, the Land Law alone has 104 contents, the Housing Law has 64 contents, the Real Estate Business Law has 22 contents assigned to the Government and government agencies for detailed regulation.

“All three major laws above take effect from January 1, 2025, so all detailed regulations must be issued synchronously,” Mr. Vuong Dinh Hue especially emphasized.

Thoroughly grasping the new and key contents of each law, including 9 contents of the Land Law, 5 contents of the Housing Law, 9 contents of the Real Estate Business Law, Vice Chairman of the National Assembly Nguyen Khac Dinh clearly stated the requirements for the Government and Government agencies in organizing implementation. Accordingly, the documents detailing and guiding the implementation of nearly 400 contents assigned in the law and resolution of the National Assembly must take effect at the same time as the law takes effect.

In the process of issuing documents detailing and guiding the implementation of the Land Law, it is recommended that the Government focus on the contents of proposing plans to change the method of land classification in accordance with the conditions and methods of state management in the new conditions, and develop an implementation roadmap, considering this as one of the breakthrough contents of the next stage.

Along with that, review the really necessary land use indicators to determine in the content of provincial and district land use planning in a synchronous and unified manner with the indicators in construction planning and urban planning. Do not create unreasonable land use indicators, lack of flexibility, inconsistent with the laws of the socialist-oriented market economy, hinder development, cause difficulties for production and business activities of enterprises and people's lives.

Naming 9 decrees and 6 circulars expected to be issued in 2024 to implement the Land Law, Chairman of the National Assembly's Economic Committee Vu Hong Thanh said that the National Assembly agencies will supervise the issuance of these documents. "The supervision aims to ensure that the decrees and circulars must be detailed, complete, and consistent with the policy content stipulated in the 2024 Land Law; ensure the inheritance, stability, and development of the land law system; and consistency and synchronization with documents detailing the Housing Law, the Law on Real Estate Business, and the legal system," Mr. Thanh stated.

Actively prepare land for social housing

One of the very new points of the Housing Law is the regulation that the Vietnam General Confederation of Labor is the governing body of investment projects to build social housing using trade union financial resources for workers and laborers who are eligible for social housing policies to rent.

According to Mr. Ngo Duy Hieu, Vice President of the Vietnam General Confederation of Labor, immediately after the Housing Law was passed (November 2023), the General Confederation deployed many activities, including disseminating the provisions of the Law to key union officials and workers, in order to raise awareness and unify actions within the union system on workers' housing issues.

This agency has also directed the development of housing investment procedures in accordance with the provisions of construction law and investment law, closely following the new contents of the Housing Law and the Draft Decree of the Ministry of Construction being submitted to the Government.

Notably, the Vietnam General Confederation of Labor has directed the review of localities that have introduced land locations to the General Confederation to conduct a survey on workers' housing needs. Since the Law was passed, this has been implemented in the provinces of Bac Giang, Bac Ninh, Tien Giang and Hai Phong City. It is expected that in the second quarter of 2024, the survey will continue in 6 other provinces. After the survey, detailed planning will be carried out and investment preparation, investment and post-investment work will be carried out.

Mr. Hieu also said that the Vietnam General Confederation of Labor has implemented a housing construction project in stages. Accordingly, it is expected to invest in building 3,000 houses by 2025 and from 2026 to 2030, it is expected to build from 10,000 to 15,000 houses for workers.

It is not only the responsibility of the National Assembly and the Government.

To enforce the law well, it is necessary to do a good job of disseminating and propagating the law. This is not only the responsibility of the National Assembly and the Government, but also the responsibility of organizations and associations such as VCCI.

On March 21, in Hanoi, VCCI will coordinate with the Ministry of Natural Resources and Environment to introduce new points of the Land Law and the impact of these policies on businesses. A similar activity will take place on April 4 in Ho Chi Minh City.

Also related to social housing, Vice Chairman of Hai Phong City People's Committee Nguyen Duc Tho informed that in the coming time, the demand for housing for workers in the city is very large. According to the Social Housing Construction Project approved by the Prime Minister, Hai Phong is assigned the target of 33,500 social housing units by 2030.

Hai Phong leaders said that the city has proactively linked social housing investment with socio-economic development. At the same time, it has selected and allocated land for the social housing system, aiming to proactively and flexibly develop housing, prioritizing the maximum exploitation of inefficiently used land in urban areas, strengthening propaganda about the State's policy on social housing..., to bring the policy into life.

From the responsibility of the supervisory agency, Chairman of the Law Committee Hoang Thanh Tung said that the Standing Committee of this Committee is advising the National Assembly's Thematic Supervisory Delegation on "implementation of policies and laws on real estate market management and social housing development from 2015 to the end of 2023", focusing on the content of social housing development. "This is a major policy content, very important to bring the Housing Law into life", Mr. Hoang Thanh Tung emphasized.
