Can teachers register to teach extra classes?

Extra teaching and learning activities will continue to increase in all areas until Circular 29/2024 issued by the Ministry of Education and Training officially takes effect.

According to the Ministry of Education and Training , the issuance of regulations in Circular 29/2024 aims to ensure increased responsibility of schools in fully implementing the requirements set out in the general education program. At the same time, it limits the practice of "forcing students to take extra classes" that has caused public outrage over the past time.

Article 4 of Circular 29/2024 stipulates that teachers at public schools are not allowed to organize, operate, or manage extra classes, but are only allowed to teach extra classes outside of school under contract. Therefore, teachers at public schools are not allowed to register a business household to teach extra classes outside of school.

Regarding the form of business registration, Clause 2, Article 17 of the Enterprise Law 2020 clearly states 7 groups of subjects prohibited from establishing and managing enterprises in Vietnam. Among them are cadres, civil servants, and public employees, according to the provisions of the Law on Cadres, Civil Servants, and the Law on Public Employees. Therefore, public school teachers are not allowed to establish and manage enterprises.

At the same time, teachers who are teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned by the school to teach according to the school's educational plan.

Teachers who are teaching at school and participate in extra-curricular teaching outside of school must also report to the head of school about the subject, location, form, and time of extra-curricular teaching.

Responsibilities of tutors

Article 14, Circular 29/2024 stipulates the responsibilities of teachers when participating in extra teaching activities as follows:

• Implement the regulations on extra teaching and learning in this Circular and other relevant legal regulations.
• Manage and ensure the quality of extra teaching and learning and the rights of students and tutors; manage and use extra study money according to regulations.
• Manage and keep records of extra teaching and learning organizations according to regulations.
• Report and explain the implementation of the provisions of this Circular and relevant legal provisions to competent authorities when requested.
• Receive and handle opinions, recommendations and wishes of students and parents about extra teaching and learning before and during the implementation process.

Along with that, the Circular increases the management responsibility of the Principal with teachers when they participate in extra-curricular teaching. Specifically, teachers who teach extra-curricular teaching must report to the Principal about the subject, location, form, and time of extra-curricular teaching.
