In recent days, information has appeared that Son Hai Group Company Limited (Son Hai Group) sent a complaint to Thanh Hoa Provincial Police about the act of vandalizing signs on the Nghi Son - Dien Chau expressway running through Thanh Hoa and Nghe An provinces.

On the sign, in addition to information about the route and speed limit regulations, at the bottom there is also the line "Son Hai road section has a 10-year warranty".

This is a route of the North-South Expressway constructed by Son Hai contractor under the form of public investment (using state budget capital) and put into operation on September 1, 2023.

This enterprise claimed that a group of people went along Nghi Son - Dien Chau highway and vandalized 9 10-year warranty commitment signs of Son Hai Group from Km380+000 to Km385+200 of the XL01 package.

It is known that the Vietnam Infrastructure Development and Finance Investment Corporation (Vidifi - the highway maintenance unit) is the unit that removed these signs. Vidifi representative explained that on October 1, Vidifi received an official dispatch from Road Management Zone II requesting to adjust some inappropriate signs, causing confusion for vehicle owners participating in traffic when entering and exiting the highway.

The document clearly stated that at 9 locations on Nghi Son - Dien Chau highway, the signs with the words "Son Hai road section has a 10-year warranty" are not up to standard.

Meanwhile, Road Management Area II said that the removal of the signboard at the construction package by Son Hai Group at Nghi Son - Dien Chau Expressway to erase the words "Son Hai Road has a 10-year warranty" was carried out under the direction of the State Inspection Council for Construction Acceptance and the Vietnam Road Administration.

In the project design documents approved by competent authorities, the completion documents for the sign category have designs and contents about street names, maximum and minimum speeds, and do not have contractor warranty information.

In mid-2024, the State Inspection Council for Construction Acceptance inspected the project and requested Project Management Board 6 (representing the investor) to direct the construction contractor to repair and fix the problem in accordance with the design documents.

However, the parties did not comply, so Road Management Area II requested the regular maintenance management unit to immediately repair the signs that did not comply with the design documents and had advertising text that did not meet standards.

Also related to this issue, a representative of the Vietnam Road Administration said: Article 45 of the Road Traffic Law stipulates that road signs belong to road signal works. In addition, the Road Traffic Law also stipulates: "It is not allowed to attach to road signal works any content unrelated to the meaning and purpose of the road signal works".

In the national technical regulation QCVN 41:2019 on road signs, there are no regulations on construction warranty period or commitment on construction warranty period on signs.

The representative of the Vietnam Road Administration also emphasized that the Construction Law and other construction law provisions do not have regulations on the requirement to attach warranty commitment signs on construction works.

Therefore, the Son Hai contractor's installation of the words "Son Hai road section warranted for 10 years" on the Nghi Son - Dien Chau expressway sign is not in accordance with the law.

The Roads Department also confirmed that this is a construction project using state capital. After completion, the project will have to compile a dossier and hand over the property to a state agency for management. Therefore, the Son Hai contractor's statement that the signs on the Nghi Son - Dien Chau Expressway are the company's property is incorrect./.
