On the morning of July 6, the Hanoi People's Council passed a Resolution regulating the minimum housing area for permanent residence registration at legal rented, borrowed, or shared accommodation in the area. The Resolution takes effect 10 days after its promulgation until 2030.
Regarding the subjects of application: Vietnamese citizens registering permanent residence in legal accommodation rented, borrowed, or temporarily staying in Hanoi, except for the cases specified in Clause 2, Article 20 of the 2020 Law on Residence; Residence registration agencies in Hanoi; People's Committees at all levels; Organizations and individuals owning legal accommodation for rent, borrowing, or temporarily staying.
Regarding the scope of regulation, the resolution stipulates the minimum housing area conditions for permanent residence registration at legal accommodation due to renting, borrowing, or staying with others in the city. The prescribed area for suburban areas (including 18 districts and towns) is 8 m2 of floor space/person and for inner city areas (including 12 districts) is 15 m2 of floor space/person.
The Hanoi People's Committee is assigned to organize the implementation of this resolution. During the implementation process, the City needs to review and evaluate the impacts to adjust and supplement appropriate regulations according to reality.

Previously, according to the audit report of the Legal Committee of the City People's Council, Hanoi is a special urban area with great pressure of mechanical population growth, the number of registered residents is increasing rapidly and fluctuating a lot. In particular, the population in the historical inner city area maintains a high density and has exceeded the regulations.
The population of this area is expected to decrease to 0.8 million by 2030, but so far it has exceeded 1.2 million. Hanoi's population has increased in recent years mainly due to mechanical increase from immigrants.
The population growth in inner-city districts, especially in the expanded inner-city districts such as Cau Giay, Hoang Mai, Thanh Xuan, is creating many pressures such as overloading of traffic infrastructure, social infrastructure, security management, public order, ensuring living environment...
The rapid increase in population size and rapid population growth have created pressure on the City's authorities at all levels in leadership and management to ensure conditions for education , health care, social security and other conditions for residents in the city, especially in inner-city districts.
The regulation on minimum housing area for permanent residence registration at legal accommodation rented, borrowed, or shared is one of the minimum criteria for the city to determine in developing mechanisms and policies to ensure necessary living conditions for people, in accordance with the requirements of residence management and the situation and social security policies in the city.
Therefore, the Legal Committee agrees with the viewpoint and principles of building the Resolution of the City People's Council according to Clause 2, Article 3 of the 2020 Law on Residence, which is "Ensuring harmony between the legitimate rights and interests of citizens, the interests of the State, the community and society; combining the guarantee of the right to freedom of residence, other basic rights of citizens and the responsibility of the State with the task of building and developing the socio-economy , strengthening national defense and security, ensuring social order and safety".
The City People's Committee's submission to the City People's Council to issue this Resolution is one of the solutions to have mechanisms and policies to ensure the tasks of urban development of the Capital .
