On the morning of October 11, continuing the fourteenth plenary session, under the direction of Deputy Chairman of the Committee Nguyen Phuong Tuan, the Committee on Science, Technology and Environment examined the draft Law on High Technology (amended). Attending the meeting was Permanent Deputy Minister of Science and Technology (MOST) Vu Hai Quan.

Overview of the meeting.

Perfecting the high-tech development institution is an urgent requirement.

According to the Government's submission, the proposal to develop the Law on High Technology (amended) aims to: Institutionalize the Party's guidelines and policies, the State's policies on perfecting the legal corridor to promote CNC development in accordance with the requirements of socio -economic development in the 2021-2030 period, with a vision to 2045 and international integration in the new situation; implement the policy of promoting decentralization, assigning state management authority to local authorities at all levels in promoting CNC development, especially CNC zones. At the same time, ensure consistency, transparency, feasibility, avoid overlap with the current system of legal documents and remove obstacles and barriers to high technology development today.

Speaking at the meeting, Permanent Deputy Minister of Science and Technology Vu Hai Quan said that this amendment to the Law on High Technology aims to concretize and implement Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo on science, technology and innovation development to 2030, with a vision to 2045.

The Law on High Technology (CNC) was issued in 2008, the first and only law regulating this sector. After more than 16 years, the CNC Law has revealed many limitations in incentives, technology list, CNC zones and implementation organization, requiring comprehensive amendments to overcome shortcomings and promote development.

The draft Law on High Technology (amended) consists of 06 chapters and 27 articles, reducing 08 articles and having changes in structure and form compared to the current Law on High Technology, inheriting to the maximum the contents of the current Law that have been effectively implemented in the past time. The draft Law is designed according to the principles of simplifying administrative procedures, strengthening post-inspection, comprehensive digital transformation in CNC management and operations. Changing management thinking towards effective management, not process management. Attracting non-state budget investment sources for CNC through encouraging enterprises to invest, funding for research, CNC development, strategic technology, CNC products, strategic technology products.

The preliminary review report of the Committee on Science , Technology and Environment said that the draft Law has ensured constitutionality, legality, and has no provisions that contradict international treaties to which Vietnam is a member. However, it is recommended that the drafting agency continue to review and compare the provisions of the draft Law to ensure the consistency of the legal system such as the Law on Science, Technology and Innovation, the Law on Digital Technology Industry, the Law on Corporate Income Tax, etc. In particular, special attention should be paid to the draft Laws currently submitted to the National Assembly.

During the discussion, delegates basically agreed with the Government's Submission and the Preliminary Review Report of the Committee on Science, Technology and Environment, and at the same time contributed many opinions to perfect the content of the draft Law.

Delegate Nguyen Van Thi - Delegation of National Assembly Deputies of Bac Ninh Province, member of the Committee on Science, Technology and Environment, said that the provisions on policies for agricultural enterprises applying CNC and agricultural zones applying CNC in the draft Law should not be omitted. The delegate emphasized that one of the contents put forward in Resolution No. 19-NQ/TW on agriculture, farmers and rural areas by 2030, with a vision to 2045, is to create breakthroughs in research, application of science and technology, innovation, digital transformation; and training of human resources in agriculture and rural areas. The delegate suggested a more comprehensive practical assessment of the application of high technology in the agricultural sector.

Sharing the same view, delegate Thai Thi An Chung - Deputy Head of the National Assembly Delegation of Nghe An province, member of the Committee on Science, Technology and Environment, said that removing regulations on policies for high-tech agricultural enterprises and high-tech agricultural zones is unreasonable. The delegate stated that our country is an agricultural country, so it is necessary to have policies to support high-tech agricultural enterprises as well as develop high-tech agricultural zones. Encourage high-tech agricultural enterprises to innovate and digitalize in agriculture.

Contributing comments to the draft Law, Delegate Trang A Duong, full-time member of the Ethnic Council, suggested that the drafting agency study and supplement policies to prioritize investment in technology infrastructure to implement 5G coverage in mountainous areas, remote areas, and ethnic minority areas. At the same time, he suggested amending some phrases in the draft to ensure comprehensiveness and consistency with long-term development goals.

Regarding the explanation of the terms mentioned in the draft Law, Delegate Phan Xuan Dung - National Assembly Delegation of Khanh Hoa province, member of the Committee on Science, Technology and Environment, said that the drafting committee needs to conduct careful research to fully and accurately define the concepts of high technology, strategic technology, high-tech products, etc. to suit the context of the Fourth Industrial Revolution.

Delegates appreciated the need to amend the Law on High Technology, saying that perfecting the institution and building a legal corridor for high technology development is an urgent requirement, in line with the direction of the Politburo and the Government. This is an important political basis, demonstrating the determination to innovate the growth model based on science, technology and innovation. Some opinions also emphasized that the draft Law has ensured institutionalization and is consistent with the guidelines, policies and guidelines of the Party and State.

Speaking at the meeting, Mr. Nguyen Phu Hung, Director of the Department of Science, Technology and Engineering, acknowledged the valid and dedicated opinions of the delegates, experts and scientists, and explained and clarified the opinions of the delegates on the interpretation of terms and the abolition of regulations on high-tech agricultural zones. The Ministry of Science and Technology will absorb, continue to study and complete the draft Law for submission to the National Assembly for consideration.

Concluding the meeting, Deputy Chairman Nguyen Phuong Tuan said that the Committee will continue to complete the Verification Report to submit to the National Assembly Standing Committee. At the same time, he requested the Ministry of Science and Technology to study and absorb the comments in depth, and continue to carefully review to complete the draft Law in a careful and complete manner, ensuring synchronization and consistency with other Laws.
