On the morning of October 30, Deputy Prime Minister Tran Hong Ha chaired an online conference to implement the Prime Minister's direction on resolving difficulties and problems related to land valuation.
At Ninh Binh province, comrade Tran Song Tung, member of the Provincial Party Standing Committee, Vice Chairman of the Provincial People's Committee chaired the conference.
Speaking at the conference, a representative of the Ministry of Natural Resources and Environment said that after 9 years of implementing Decree No. 44/2014/ND-CP dated May 15, 2014 of the Government regulating land prices, the regulations on land prices in the 2013 Land Law have basically created a synchronous legal corridor and a strict process; through specific land valuation, land prices have basically been consistent with market prices, limiting losses to the State budget, ensuring the rights of people whose land has been recovered.
However, some provisions in Decree No. 44/2014/ND-CP are no longer suitable for current reality and have not kept up with social changes. Therefore, it is necessary to issue a Decree amending and supplementing Decree No. 44/2014/ND-CP to promptly complete regulations on land valuation methods, innovate specific land valuation procedures to ensure the unification of land resources, and at the same time guide localities to unify the implementation of the Provincial People's Committee's authorization to the District People's Committee to decide on specific land prices according to the provisions of the Law on Organization of Local Government, Resolution No. 73/NQ-CP, dated May 6, 2023 of the Government.
In addition, the Ministry of Natural Resources and Environment also proposed to amend and supplement a number of articles of Decree No. 10/2023/ND-CP dated April 3, 2023 of the Government amending and supplementing a number of articles of the Decrees guiding the implementation of the Land Law because some localities reflected problems related to Article 17a on auction of land use rights when the State allocates land with land use fees and leases land.
The draft Decree includes 15 contents amending and supplementing Decree No. 44/2014/ND-CP of the Government regulating land prices; 2 contents supplementing and abolishing a number of phrases of Decree No. 10/2023/ND-CP, dated April 3, 2023 amending and supplementing a number of articles of the Decrees guiding the implementation of the Land Law; 2 contents of transitional regulations and appendices ensuring full and detailed instructions on how to implement the contents in the draft Decree.
At the conference, delegates contributed opinions related to land valuation methods, transitional regulations and issues of disagreement in the draft Decree.
Concluding the conference, Deputy Prime Minister Tran Hong Ha highly appreciated the contributions of the delegates. The opinions were profound, demonstrating enthusiasm, responsibility, and multi-dimensional perspectives from practice with many different angles. The Deputy Prime Minister assigned the Ministry of Natural Resources and Environment to seriously absorb and select the contributions to synthesize and report to competent authorities for adjustment and supplementation so that the Decree when issued ensures the most complete and feasible, harmoniously resolving the relationship of interests related to land, in line with the development trend of the country.
