Consolidate regulations on retirement at older ages for officials and civil servants holding leadership and management positions

Accordingly, the applicable subjects include:

Firstly, female cadres and civil servants holding the following positions and titles: a) Deputy Head of a Party agency or department at the central level; Deputy Director of the Ho Chi Minh National Academy of Politics, Deputy Editor-in-Chief of Nhan Dan Newspaper, Deputy Editor-in-Chief of Communist Magazine; b) Vice Chairman of the Central Committee of the Vietnam Fatherland Front; c) Vice Chairman of the Ethnic Council, Vice Chairmen of the National Assembly Committees, Deputy Head of the National Assembly Office; d) Deputy Chief Justice of the Supreme People's Court, Deputy Chief of the Supreme People's Procuracy ; dd) Deputy Minister, deputy of the head of a ministerial-level agency; e) Deputy Head of the Office of the President, Deputy State Auditor General; g) Deputy Head of central socio-political organizations; h) Deputy Secretary of a provincial Party Committee, city Party Committee, Party Committee of a centrally-affiliated bloc; Chairman of the People's Council, Chairman of the People's Committee of a province or centrally-affiliated city; i) Member of the Central Inspection Commission; k) Director of the Truth National Political Publishing House; l) Director of the Institute for Legislative Studies under the Standing Committee of the National Assembly; m) Director of Hanoi National University, Director of Ho Chi Minh City National University, General Director of Vietnam Social Security, Head of the Ho Chi Minh Mausoleum Management Board, Chairman of the National Financial Supervision Committee; Vice Chairman of the State Capital Management Committee at Enterprises; n) Vice Chairman of the People's Council, Vice Chairman of the People's Committee of Hanoi and Ho Chi Minh City; o) Standing member of the Ethnic Council and Committees of the National Assembly; p) Member of the Standing Committee of the Hanoi and Ho Chi Minh City Party Committees; q) Member of the Standing Committee of the Provincial Party Committee and City Party Committee who is an ethnic minority.

Second, civil servants are appointed to the positions of Judge of the Supreme People's Court and Prosecutor of the Supreme People's Procuracy.

Principles for implementing retirement at an older age

First, ensure objectivity, fairness, transparency and compliance with regulations.

Second, the competent authority shall decide on retirement at a higher age for cadres and civil servants as prescribed in this Decree, but must ensure that the retirement age does not exceed 65 years old for men and 60 years old for women.

Third, cadres and civil servants specified in Clause 1, Article 2 of this Decree, when decided by competent authorities to retire at an older age, shall continue to hold leadership and management positions.

Fourth, during the implementation of the retirement policy at an older age, if cadres and civil servants wish to retire, their retirement benefits will be resolved according to the provisions of law.

Working time when retiring at older age

For cadres and civil servants specified in Clause 1, Article 2 of this Decree, the working time upon retirement at an older age shall not exceed 60 years old.

For the cases specified in Clause 2, Article 2 of this Decree, the working time upon retirement at an older age shall not exceed 65 years old for men and 60 years old for women.

This Decree does not apply to the following subjects: Officials holding positions of Minister or equivalent or higher; Officials and civil servants specified in Clause 1, Article 2 of this Decree who are members of the Party Central Committee; Assistants and secretaries of the General Secretary, President, Prime Minister, Chairman of the National Assembly, Standing member of the Secretariat, Politburo member, member of the Secretariat, Vice President, Deputy Prime Minister, Vice Chairman of the National Assembly.

Retirement at an older age in the cases specified in Clause 3, Article 2 of this Decree shall be implemented in accordance with the regulations of the competent Party agency.

This Decree comes into force from October 20, 2022.

This Decree replaces Decree No. 53/2015/ND-CP dated May 29, 2015 of the Government regulating retirement at a higher age for cadres and civil servants and Decree No. 104/2020/ND-CP dated September 4, 2020 of the Government amending and supplementing Decree No. 53/2015/ND-CP dated May 29, 2015 of the Government regulating retirement at a higher age for cadres and civil servants.
