On the afternoon of August 22, continuing the meeting program, at the National Assembly House, the National Assembly Standing Committee considered and decided on adjusting the Law and Ordinance Building Program under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh.
The Government proposed to add the draft Law amending and supplementing a number of articles of the Law on Health Insurance to the 2024 Law and Ordinance Development Program.
Presenting a proposal to add the draft Law amending and supplementing a number of articles of the Law on Health Insurance to the 2024 Law and Ordinance Development Program, Deputy Prime Minister and Minister of Justice Le Thanh Long said that the Government is necessary to propose the development of a Law amending and supplementing a number of articles of the Law on Health Insurance to continue institutionalizing the Party's viewpoints and policies and strengthening the State's leadership and management of health insurance work.
In recent times, the Party and the National Assembly have issued many documents guiding the implementation of policies and laws on grassroots health and preventive medicine, such as Resolution No. 20-NQ/TW dated October 25, 2017 of the 12th Party Central Committee on strengthening the protection, care and improvement of people's health in the new situation; Directive No. 25-CT/TW dated October 25, 2023 of the Secretariat on continuing to consolidate, improve and improve the quality of grassroots health activities in the new situation; Resolution No. 42-NQ/TW dated November 24, 2023 of the 13th Party Central Committee on continuing to innovate and improve the quality of social policies to meet the requirements of national construction and defense in the new period...
In order for these orientations and strategies to be institutionalized in the Law, ensuring the rights and interests of the people related to the Law on Health Insurance, the requirement is to urgently research and submit to the National Assembly amendments to the Law on Health Insurance; at the same time, overcome the limitations, difficulties and inadequacies of the current Law on Health Insurance and meet the objective practical requirements in the new situation.
After 15 years of implementing the law, in addition to the achieved results, the implementation of the Law on Health Insurance has encountered a number of difficulties, obstacles and inadequacies regarding the subjects participating in the Law on Health Insurance; the scope of benefits of the Law on Health Insurance; initial medical examination and treatment registration, connecting and transferring lines; health insurance contribution levels; management and use of health insurance funds; names of medical examination and treatment facilities; health insurance medical examination and treatment contracts; health insurance appraisal; management and responsibilities of relevant parties in implementing health insurance policies; there is no mechanism to resolve disputes and obstacles regarding the Law on Health Insurance; sanctions are still lacking or not strong enough to ensure compliance and effectiveness of law enforcement...
The Deputy Prime Minister emphasized that in order to resolve these difficulties and shortcomings, it is necessary to promptly study, amend and supplement the provisions of the current Law on Health Insurance; at the same time, based on the Law on Promulgation of Legal Documents, the Ministry of Health has proposed to develop a Law amending and supplementing a number of articles of the Law on Health Insurance; the proposal for the law has been reviewed and commented on by the Government in Resolution No. 97/NQ-CP dated June 24, 2024 with 4 policies.
Specifically, adjusting the subjects participating in health insurance in line with relevant legal provisions; adjusting the scope of health insurance benefits in accordance with the contribution level, balancing the health insurance fund and health care requirements in each period; adjusting relevant health insurance regulations according to the level of technical expertise in medical examination and treatment and promoting the role of grassroots health care in primary health care and health insurance medical examination and treatment; effectively allocating and using the health insurance fund.
Based on the prepared law-making proposal dossier, the Government proposes that the National Assembly Standing Committee consider allowing the addition of the law project to the 2024 Law and Ordinance Development Program, and submit it to the National Assembly for consideration and approval at a session (8th Session, 15th National Assembly).
Presenting the review report, Chairman of the Law Committee Hoang Thanh Tung said that the Law Committee and agencies of the National Assembly agreed on the necessity of amending and supplementing a number of articles of the Law on Health Insurance to institutionalize the Party's policies and guidelines, promptly overcome a number of limitations, difficulties and inadequacies of the current Law, meet practical requirements, and be consistent with relevant provisions of the Law on Medical Examination and Treatment and the Law on Social Insurance.
The Law Committee requested the Government to report more clearly on the reasons for not yet comprehensively amending the Law on Health Insurance, the roadmap for comprehensively amending this law to fully institutionalize the Party's policies and guidelines and comprehensively overcome the limitations, obstacles and inadequacies that have been pointed out in the organization of the implementation of the Law on Health Insurance. The content of the basic policies is consistent with the Party's policies and guidelines, ensuring constitutionality and legality.
Along with that, regarding the adjustment of health insurance participants in line with relevant legal regulations, it is recommended to continue research and have a mechanism to ensure the maintenance of health insurance benefits for employees...
