Urgently complete draft laws to submit to the National Assembly in October 2025

At this Session, the Government discussed and gave opinions on 09 important draft laws in key areas of political , economic, social, security, defense and foreign affairs life: (1) Draft Law on Personal Income Tax (amended); (2) Draft Law on High Technology (amended); (3) Draft Law on amending and supplementing a number of articles of the Law on Technology Transfer; (4) Draft Law on amending and supplementing a number of articles of the Law on Intellectual Property; (5) Draft Law on amending and supplementing a number of articles of the Law on International Treaties; (6) Draft Law on amending and supplementing 10 Laws related to security and order; (7) Draft Law on Protection of State Secrets (amended); (8) Draft Law amending and supplementing a number of articles of 15 Laws in the field of agriculture and environment (Law on Environmental Protection; Law on Plant Protection and Quarantine; Law on Animal Husbandry; Law on Biodiversity; Law on Dikes; Law on Surveying and Mapping; Law on Hydrometeorology; Law on Forestry; Law on Natural Disaster Prevention and Control; Law on Water Resources; Law on Marine and Island Resources and Environment; Law on Veterinary Medicine; Law on Irrigation; Law on Fisheries; Law on Cultivation); (9) Draft Law on Press (amended).

The Government requested the Ministers to direct the drafting agencies to promptly complete the draft laws to ensure proper implementation of the provisions of the Law on Promulgation of Legal Documents; closely coordinate with the National Assembly Committees to ensure the quality and progress of submission to the National Assembly at the 10th Session in October 2025; the Deputy Prime Ministers in charge of the fields to direct the completion of the draft laws, coordinate with the Vice Chairmen of the National Assembly in the process of submitting these draft laws to the National Assembly. Based on the review of the submission documents of the ministries and the opinions expressed at the Session, the Government unanimously resolved on the above draft laws.

Completing the draft Law on Personal Income Tax (amended)

In particular, with the draft Law on Personal Income Tax (amended), the Government agrees on the necessity of developing a draft Law to continue institutionalizing the Party's guidelines and policies, the State's policies and laws on perfecting the tax policy system in general and the personal income tax policy in particular; promptly develop a draft Law on the basis of closely following the content of the policies approved by the Government in Resolution No. 191/NQ-CP dated June 26, 2025.

The Ministry of Finance shall preside over and coordinate with relevant ministries and agencies to study and fully absorb the opinions of Government members and the conclusions of the Prime Minister, and complete the draft Law to ensure the following requirements:

- Continue to review the provisions of the draft Law to ensure consistency with the provisions of the Constitution and relevant legal provisions (Land Law, Securities Law, Social Insurance Law and laws on high technology...); at the same time, meet the requirements of improving tax management, collecting correctly, fully and promptly, while ensuring equal treatment among taxpayers.

- Review and add income (severance pay, allowances, subsidies, living expenses paid by Vietnamese agencies abroad...) to the tax-exempt list.

- Complete the regulations on progressive tax schedule according to option 2 as reported by the Ministry of Finance in Submission No. 570/TTr-BTC dated September 7, 2025.

- Carefully assess the impact on the content of regulations on personal income tax on business income, avoid causing major disruption to people's business activities, and at the same time effectively implement the policy of eliminating tax collection for business households and business individuals according to Resolution No. 68-NQ/TW dated May 4, 2025 of the Politburo on private economic development, Resolution No. 198/2025/QH15 dated May 17, 2025 of the National Assembly on a number of special mechanisms and policies for private economic development.

- Clearly define income from gold trading activities as taxable to enhance market transparency and limit gold speculation. Assign the Ministry of Finance to coordinate with the State Bank to unify this content in the draft Law.

- Further strengthen decentralization and delegation of power; in which the Government shall specify in detail the fluctuating issues to ensure flexibility in direction and administration.

The Ministry of Finance shall preside over and coordinate with relevant ministries and agencies to promptly complete the draft Law dossier in accordance with the provisions of the Law on Promulgation of Legal Documents. The Minister of Finance shall be assigned, on behalf of the Government, to sign the Submission to the National Assembly for consideration, comment and approval of this draft Law at the 10th Session of the 15th National Assembly (October 2025).

Assign Deputy Prime Minister Ho Duc Phoc to direct the process of completing this Law project.

Continue to carefully review the content of the draft Law on High Technology (amended) to avoid duplication and overlap with regulations in relevant legal documents.

The Government agreed on the necessity of developing a draft Law on High Technology (amended) to institutionalize the Party's guidelines and policies, the State's policies and laws on science, technology, innovation and national digital transformation in Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo on breakthroughs in science, technology, innovation and national digital transformation development and the Party and State's viewpoints and directions related to this issue.

The Ministry of Science and Technology shall preside over and coordinate with ministries and agencies to fully absorb the opinions of Government members and the conclusions of the Prime Minister, and complete the draft Law to ensure the following requirements:

- Continue to carefully review the content of the draft Law to avoid duplication and overlap with regulations in relevant legal documents that have been issued or are being drafted, submitted to the National Assembly for promulgation, focusing on strategic technology sectors and fields to create breakthroughs, create a legal corridor to form strong research groups (both domestic and foreign), encourage M&A activities of foreign companies holding core technology to take shortcuts and receive technology transfer.

- Consider the need to include regulations related to "high-tech urban areas" in the draft Law on High Technology (amended) or related specialized laws (Law on Urban and Rural Areas); where necessary, there should be specific regulations to ensure that preferential and support policies only apply to high-tech activities, research and development activities of strategic technology and serve the development of infrastructure and facilities directly serving high-tech activities, ensuring that preferential policies are targeted to the right subjects and objectives, effectively promoting research, application and development of high technology, avoiding budget waste or taking advantage of tax incentives to affect state budget revenue.

- Carefully review and complete the regulations on High-tech Agricultural Zones in the draft Law, ensuring that the promulgated policies are effective and overcome existing shortcomings and shortcomings in the operation of High-tech Agricultural Zones that have been formed recently, contributing to promoting and developing Vietnam's agricultural sector through research activities and application of high technology and strategic technology.

- Continue to review and minimize administrative procedures, promote decentralization and delegation of power thoroughly, creating favorable conditions for organizations, businesses and individuals to implement in practice after the Law is passed by the National Assembly.

The Ministry of Science and Technology shall preside over and coordinate with relevant ministries and agencies to urgently complete the draft Law dossier in accordance with the provisions of the Law on Promulgation of Legal Documents. The Minister of Science and Technology shall be assigned, on behalf of the Prime Minister, to sign the Submission to the National Assembly for consideration, comment and approval of this draft Law at the 10th Session of the 15th National Assembly (October 2025).

Assign Deputy Prime Minister Nguyen Chi Dung to direct the process of completing this Law project.

Draft Law amending and supplementing a number of articles of the Law on Environmental Protection; Law on Plant Protection and Quarantine; Law on Animal Husbandry; Law on Biodiversity; Law on Dikes; Law on Surveying and Mapping; Law on Hydrometeorology; Law on Forestry; Law on Natural Disaster Prevention and Control; Law on Water Resources; Law on Marine and Island Resources and Environment; Law on Veterinary Medicine; Law on Irrigation; Law on Fisheries; Law on Cultivation:

The Government agreed on the necessity of developing a Law project to institutionalize the Party's guidelines and policies, and the Government's direction on agricultural and rural development, natural resources and environmental management; to overcome difficulties and shortcomings in the process of implementing the Law; to ensure compliance with organizational arrangement, streamlined apparatus, and effective and efficient operation.

The Ministry of Agriculture and Environment shall preside over and coordinate with relevant ministries and agencies to study and absorb as much as possible the opinions of Government members and the conclusions of the Prime Minister, and complete the draft Law to ensure the following requirements:

Fully institutionalize the Party and State's policies and guidelines on perfecting the arrangement and streamlining of the organizational apparatus, ensuring unity, synchronization, and improving effectiveness and efficiency in serving people and businesses.

Continue to specify the provisions of the 2013 Constitution (amended and supplemented by Resolution No. 203/2025/QH15 dated June 16, 2025) on human rights and civil rights, in accordance with international treaties to which the Socialist Republic of Vietnam is a member, ensuring the consistency and unity of the legal system.

Only amend and supplement the contents that are "bottlenecks" that need to be removed, which are universal in nature in all provinces and cities, and if amended, will have an impact on promoting socio-economic development; contents with clear political basis stated in resolutions, conclusions, and directions of the Party, the National Assembly, the Government, key leaders, and the Prime Minister; issues that are being piloted and proven correct in practice, issues that are mature and clear and bring about positive, sustainable, stable, and long-term effectiveness; do not use law amendments and supplements to handle individual cases. The content of the Draft Law must ensure the systematic and synchronous nature of the law.

Carefully assess the impact on new regulations and policies, collect opinions from subjects directly affected by each policy in accordance with legal regulations on promulgating legal documents, ensuring close adherence to and concretization of the Party's policies and viewpoints on agriculture, rural areas, natural resources and environmental management; handle and resolve difficulties and shortcomings that have been summarized in the implementation of the above 15 Laws and comments from agencies, ministries, branches and subjects affected.

Inheriting relevant regulations, overcoming difficulties and problems of the 15 Laws mentioned above; in particular, this Law must meet the requirements of Vietnam's reality and conditions regarding agricultural and rural development, natural resource and environmental management; selectively refer to international legal experience and practical work in agriculture, rural areas, natural resource and environmental management of a number of countries in the world.

Strengthen decentralization and delegation of power while promoting the responsibility of leaders; coordinate with relevant ministries and agencies to carefully review the revised, supplemented, and omitted contents to ensure compliance with regulations on decentralization, delegation of power, division of authority, organization of 2-level local governments, and clearly define the content of state management for local governments; thoroughly reform administrative procedures; reduce business conditions and promote the application of technology and digital transformation in state management of agriculture and the environment; have a control mechanism to overcome the situation of pushing and avoiding in implementation, affecting the progress of work settlement, ensuring synchronization, comprehensiveness, connectivity, no omission or overlap, task intersection, and suitability with the conditions and professional capabilities of agencies and localities for difficult and complicated work.

Carefully review the transitional provisions in the draft Law to ensure compliance with the provisions of the Law on Promulgation of Legal Documents, protect the rights and interests of individuals and organizations, and avoid creating legal gaps when this Law comes into effect.

The Ministry of Agriculture and Environment shall preside over and coordinate with relevant ministries and agencies to urgently complete the draft Law dossier in accordance with the provisions of the Law on Promulgation of Legal Documents; and report to the Government before September 15, 2025.

Assign Deputy Prime Minister Tran Hong Ha to direct the completion of this Law project.
