Fake pharmaceutical warehouse in Hung Yen: Big questions about responsibility and management

The case of producing and storing more than 100 tons of fake pharmaceuticals and functional foods in Nhu Quynh town (Hung Yen) is a serious warning bell about the management and responsibility of supervising businesses.

The case of a warehouse and workshop of fake pharmaceuticals and functional foods of about 100 tons recently discovered by Hanoi City Police in Nhu Quynh town, Van Lam district (Hung Yen) has shocked public opinion.

This incident not only raises questions about the responsibility of local authorities but also reflects long-standing problems in management.

According to the police, after about a year of monitoring, using professional measures, on May 16, the Economic Police Department, Hanoi City Police successfully destroyed a group producing and trading counterfeit food, medical equipment led by Pham Ngoc Tien and his wife Doan Thi Nguyet (both born in 1988, address No. 1, LK 11, Xa La Urban Area, Phuc La Ward, Ha Dong District, Hanoi), seizing over 100 tons of fake pharmaceuticals and functional foods.

According to the police, Tien, who is a pharmacist, created the formulas for the products himself, then bought domestic materials and gave them to unqualified employees to mix into capsules and package them into foreign-origin products such as functional foods and medical equipment.

Notably, in addition to counterfeiting, these subjects still maintain imports to gain brand recognition, appeal to consumer psychology, and legalize documents to deceive authorities.

In addition, Tien also bought raw materials domestically and then transferred them to the counterfeit goods factory he established in Nhu Quynh town (Van Lam), in order to avoid the authorities.

The warehouse and workshop rented by Tien is located in a deep corner inside Ha Hung Pharmaceutical Company (Nhu Quynh town, Van Lam), adjacent to the wide DH 19 road, where many vehicles and people pass by every day.

Through research, Ha Hung Pharmaceutical Company has an area of ​​about 4 hectares; in addition to manufacturing and trading according to the registration license, the company also rents houses and factories. The company is surrounded by a fence, and at the main gate there is a security guard stationed 24/7.

According to Mr. Nguyen Van Tao, head of Hanh Lac village (Nhu Quynh town), when the police invited him to witness the warehouse search, he realized that it was a place to hide counterfeit goods. Because he had only been in charge of the village for a few days, Mr. Tao did not know whether the company had any connection with Hanh Lac village.

Chairman of the People's Committee of Nhu Quynh Town, Vu Van Sua, shared that the town's administrative level only manages production households in residential areas. For businesses located in industrial parks and clusters, this is beyond the authority of the locality, and it is impossible to closely monitor, have the capacity, and clearly understand the situation in the businesses.

When asked if the local authorities only found out about the incident when it was discovered by the police and widely reported in the media, Mr. Sua frankly admitted: for this incident, it was only when the authorities got involved that the local authorities found out.

Mr. Sua also expressed that in order to closely manage and monitor businesses and companies located in the area, authorities should be delegated to commune-level localities. Currently, commune-level authorities only coordinate with functional agencies in ensuring fire prevention, fire fighting and security and order at companies located in the area, and have no authority in other areas.

The cadastral officer of Nhu Quynh town added that after the commune level allocates land to companies and enterprises, the locality cannot ask the enterprises to report on their activities, including factory leasing.

In fact, only businesses that emit pollution into the environment that can be detected by the naked eye will have their reports sent to higher levels for resolution.

Regarding Ha Hung Company, there were no unusual external signs leading to illegal drug and functional food production activities inside. The local authorities did not expect such an incident.

“Smuggling and counterfeiting 100 tons of goods without the government, the Party committee, or the authorities knowing, I would say there are only two things: one is that there is no more will to fight, and two is that there is bribery. Both of these crimes must be dealt with immediately.” Quoting Prime Minister Pham Minh Chinh at a recent working session with the authorities, Dr. Nguyen Quang Hoa, Institute of Party History, Ho Chi Minh National Academy of Politics, said that the Prime Minister wanted to affirm his uncompromising stance on smuggling and counterfeiting - a problem that causes great damage to the country's economy, distorts the business environment, affects people's health, and undermines society's trust in the management apparatus.

The Prime Minister also requested to clarify responsibilities, not allowing "innocence" or "avoiding responsibility." This is a message requiring transparency, integrity and accountability.

Dr. Nguyen Quang Hoa further analyzed that the Prime Minister's words were not only aimed at a specific incident but were a warning message to the entire system, especially the agencies assigned to manage the State, about the situation of lax management causing serious consequences. If serious violations are allowed to go unpunished without anyone taking responsibility, people's trust will be eroded.

In the context of preventing and combating corruption and negativity at present, along with the peak period of the fight to prevent and repel smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights from May 15 to June 15 that has just been launched, the Prime Minister also expressed his will to fight against evil and wrongdoing, reset standards of public service ethics, and arouse responsibility among cadres and party members when performing assigned public duties.

The case of producing and storing more than 100 tons of fake pharmaceuticals and functional foods in Nhu Quynh town is a serious warning bell about management and responsibility in supervising businesses.

This is not only a violation of the law but also a direct threat to people's health and lives, eroding trust in the management system. Therefore, it is impossible that no one is held responsible.

Fighting against counterfeit drug crimes is not only a legal responsibility but also a moral imperative, for the safety and justice of society./.
