Mr. Ngo Van Hung complained about Decision No. 516 dated May 22, 2023 and Official Dispatch No. 1661 dated July 10, 2023 of Hoi An City People's Committee regarding support for his household due to the impact of the Duy Xuyen - Hoi An 110kV Transmission Line construction investment project at land plot No. 915, map sheet No. 00, Thanh Ha ward.
Accordingly, Mr. Hung complained to the People's Committee of Hoi An City to consider reclaiming the entire residential land area of 200m2 at plot number 915, map sheet number 00 and arrange resettlement according to the provisions of law.
In case the land with the above area is not recovered, it is recommended that the People's Committee of Hoi An City consider approving the land price for compensation and support for the entire affected land area (including 28.1 m2 of unaffected land area). At the same time, support at a higher price (19% increase compared to the price applied by the People's Committee of Hoi An City in Decision No. 158 dated February 22, 2023 of the People's Committee of Hoi An City).
Mr. Ngo Van Hung's complaint was accepted and resolved by the Chairman of Hoi An City People's Committee for the first time in Decision No. 27 dated January 12, 2024. In this Decision, the Chairman of Hoi An City People's Committee did not recognize the content of Mr. Hung's complaint.
Based on the verification results of the Provincial Inspectorate, on April 12, 2023, the Project Management Board and Land Fund of Hoi An City had a table calculating the compensation value to support Mr. Ngo Van Hung due to the limited ability to use land in the safety corridor when constructing a project with a protection corridor with an amount of more than 1,631 billion VND (171.9m2 x 11,865,000 VND/m2 x 0.8) is guaranteed according to the provisions of Point a, Clause 2, Article 28 of Decision No. 42 dated December 21, 2021 of the People's Committee of Quang Nam province.
On the other hand, the above-mentioned land plot is restricted from being used within the safety corridor when constructing the Duy Xuyen - Hoi An 110kV Transmission Line, which is not subject to land acquisition and resettlement. Therefore, Mr. Ngo Van Hung's request for support at a higher price (19% increase compared to the price applied by the Hoi An City People's Committee in Decision No. 158 dated February 22, 2023) and the request to acquire the entire 200m2 of residential land and arrange resettlement is unfounded.
Based on the discussion on the legal basis of the representative of Hoi An City People's Committee, related professional departments and the concerns of Mr. Ngo Van Hung, Chief Inspector of the province Nguyen Duc Tien concluded that the Provincial Inspectorate recommended that the Chairman of the Provincial People's Committee resolve the complaint in the direction of not recognizing the content of Mr. Ngo Van Hung's complaint against Decision No. 516 dated May 22, 2023 and Official Dispatch No. 1661 dated July 10, 2023 of Hoi An City People's Committee.
At the same time, request the Chairman of Hoi An City People's Committee to continue implementing Decision No. 27 dated January 12, 2024 on resolving Mr. Ngo Van Hung's complaint.
